Need some advice regarding housing

  • Hi All; thanks for all your brilliant advice; I have done lots of research and visited lots of offices, spoke to many advisers on the phone...
    I hope I managed to transfer tax credit into my account and made a new application for child benefit; cannot apply for housing benefit but can make amendments to council tax. It all will help.
    My biggest problem though is still house. Housing advice office advised me NOT to contact Housing association but keep paying rent if I can afford; Legal advice from Community Legal Service advised me to write a letter to Housing associaton and explain what happened and keep paying rent.
    So I am confused.
    I want to apply for the property to be transferred to me (when it comes to that) so I assume that paying rent would come as an advantage for me in long run. Does someone know if he can end the tenancy agreement while being remanded in custody? If that happens, then it means I am paying rent in his advantage - for him not to be in arrears.

    Yes he can end the tenancy even from prison - you need a solicitor urgently who can apply for an injunction to prevent him doing so and also asking that the tenancy be transferred to you as part of your divorce proceedings. Please go see someone, take care.

    Do as others advised - keep paying the rent - but if you can do so using YOUR name it will help you.
    I am not sure if this is relevant - but when my son had his breakdown and lived with me for six months all the benefits had to be changed - my DIL had to apply for housing benefit even though my son was the 'official' tenant. and they werent married. The HA were fine about this and the Housing Benefit people were too.
    I think that as its your marital home, and YOUR childrens home, as long as you pay the rent the HA may well transfer the tenancy to your name. just keep all the agencies informed, pay the rent and even if your ex DOES end his tenancy - you will probably be allowed to stay on.

    I just sent 2 emails to two local solicitors hoping to see at least one of them tomorrow. I had no idea that he can end the tenancy in his current situation. So thanks for the info kj*daisy.
    I paid rent today by my card and printed the email. I really feel that I should write to housing association and explain the situation but then - maybe he is in contact with them (how can I find out?) and if he is, I have no idea what is he saying or planning to do.
    I went to housing benefit office today and the reason I cannot apply for the benefit is apparently because my name is NOT on tenancy agreement so I have no liability - not sure what that mean; I only can apply for housing benefit once the tenancy is on my name.

  • HI All, just thought I would update you on my actions
    So I found a family solicitor, went to court and have been given non-molestation order so that's achievement.
    But an Occupation order is pending; next hearing in 2 weeks time. HA saying they cannot transfer tenancy on my name without an agreement from main tenant (my husband) although he breached tenancy agreement by commiting crime in the property and also - as I found out on Friday - by rent arrears more than £800.
    They told me to court and apply for transfer of tenancy and if court issues the order, then they will issue a new tenancy agreement on my name.
    I really worry as - of course - one of us will become homeless : him or me with 2 children.
    I need to persuade court that I am in more need that him - but apart from children's lives and wanting to keep our family home; what else can I do?
