When I seperated from my husband and reverted to my maiden name I did this with TC over the phone.
OP have you any documents from these "meetings" with the council to advise you on benefits?Trying very hard to be frugal and OS - just plodding on and doing my best!

You don't need photo ID, no. They sent me the forms in the post, but I have been to the local tax office, and there was someone else there using their council tax bill etc.
It will cost you money to get a copy of your marriage certificate (less than £10) which, if it means you will be getting lots more in TC's would surely be worth being arsed?
Remember to inform the council when your TC's do come through though, or your claim for HB will be inaccurate.0 -
Not that it would help a typical claimaint, but if anyone had the resources they could look into the feasability of a judicial review on the subject, to force them to explain disparities, such as why for example, ESA can be backdated without question (as long as eligiblity for the period can be proven) for up to three months, but it cannot be for another benefit, without a good reason.
It could be argued, if its acceptable and considered legally ok for one benefit, the same rule should apply to others.
I don't see that different rules for different benefits are (1) ultra vires, (2) procedurally unfair, or (3) irrational (Wednesbury unreasonable)....much enquiry having been made concerning a gentleman, who had quitted a company where Johnson was, and no information being obtained; at last Johnson observed, that 'he did not care to speak ill of any man behind his back, but he believed the gentleman was an attorney'.0 -
i don't think there is any probable good cause here, unless the council digs out a transcript of that phonecall and it is upheld. OP needs to state the date and time of the call and what coucil officer gave this ommittance of entitlement when specifically asked what OP could claim.
thats the only way, otherwise it is OP word against the council and that won't show good cause.0 -
I have no documents from when i visited the council, i was given nothing but verbal advice and couldnt say what date it was either.
I really dont understand how anyone could prove a council officer had said they were not entitled because the amount of visits ive had to them since April asking for help and ive not received anything at all from them until they gave me a claim form in August. I would most likely need it written down somewere and they never do anything like this.
Can anyone tell me why over 60's dont need good reason to claim HB back pay? The council officer i spoke to told me it was just a government regulation but to me it stinks of being ageist which i didnt think would be allowed these days.0 -

You have to admit though its ridiculous that over 60s can get things handed to them no problem but i am at the age of 32 no different to them , just a little younger and have to bloody grovel for money.
I really do think this is discrimination and i did mention it in my letter to the housing officer.0 -
