Because one is technically illegal and the other isn't!!

And to 'scam' the seller out of their £10 like that is also likely to lead to further hassle and abuse from them.

And 2 wrongs don't make a right and all that!

    Fraud Act:-

Making a false statement (that the seller refunded including postage) that may cause financial loss to another (other buyers who will not be aware of sellers attitude). You could even add gaining a financial advantage. It's stretching it a bit, but the fraud act is a bit loose, as Werrity may be finding out.

Take the money, agree to change feedback, change it to "seller gave me £10 refund of postage only after I left negative feedback and asked for it to be changed". Truthful, and cautionary.

Well done to the OP for sticking to their guns so that the feedback stands as a warning to other potential buyers despite being out of pocket by way of the return postage costs. The negative feedback was well deserved and exists exactly for circumstances such as this.

I think ebay only see feedback extortion in one direction e.g. When a buyer demands something from a seller that they are not entitled to in return for the buyer not leaving them negative feedback. This way round it isnt extortion as such, its an inducement to remove your feedback.

Puzzling story though isn't it? A seller sending clearly shoddy goods. Being rude to the buyer. Not cooperating at all. Then offers way over the top after receiving a neg. Did they forget about feedback during this process?
  • I think you're right macfly, she either forgot about feedback, or didn't realise the effect the feedback would have. Given that she's left it several weeks to suddenly contact me again with the offer of money, I wondered if my feedback has put other buyers off and it's bothering her? This sort of situation makes me glad that sellers can't leave negative feedback for buyers anymore - although I don't 100% agree with that policy as there are some nightmare buyers out there, I am quite sure she'd have left a neg for me by now if she could have!

the seller emailed me saying she'll send me £10 via PayPal if I remove the negative feedback and replace it with a positive comment!!!!!
This is the reason that when I'm evaluating a Seller these days, I add the number of "Revised" feedbacks to the number of Negatives to get a more accurate picture of the Seller.

I left a Negative for a Chinese seller after an item (which was described in the listing as "UK stock" and "located in UK") arrived late, having been posted from China. They offered me a full refund and I could keep the item if I revised my feedback. I just updated my Negative to state "BEWARE - seller offers to pay for feedback revision. 60+ revised feedback now."

I was given a negative and THEN offered the chance to have it removed - by paying a fiver (must have been 50% off that day :D)

I just reported her to Ebay and they removed it - then warned her for feedback extortion.

The number of feedback revisions is not indicative of 'bad' being changed for good. I have 11, all from the last few months. Without exception, they are all positive comments left with a negative red mark, they are ALL due to the iPhone app.

It has been such a problem that I no longer have to use the revision form as I complained. I now ring eBay and they manually revise them.
