I thought that the sale of goods act stated that the goods should be of mertchantable quality - soiled and scratched is not what I would call merchantable quality unless you are knowngly buying a soiled product and have been informed that it is in the soiled state.
That was my understanding but I am not certain that this is the letter of the law.

I think as long as its fit for the purpose it was intended (as its only computer hardware appearance isnt to serious unlike a 3 piece suite). I dont really think much could be done as long as it was working and doing its job0

I've had my 360 since last Jan, and its been completly fine. Albeit me moving it while playing once and destroying a demo disk, seems to think i'm the only one thats gone over a year with no problems. >.<

I am going to try taking this back to the shop i bought it from, was just wondering if anyone knew where i stood in getting this resolved by the shop. Surely microsoft are breaching the sale of goods act by giving me a second hand replacment rather than fixing my own,or giving me a brand new drive?I find it hard to accept that microsoft can expect me to accept a dirty,scratched replacement.
This happened to me and they sent out a used harddrive with someone elses working Xbox Live subscription still on it. Still using it - thanks MS!0 -
Apparently if you have your xbox 360 upright, and then move it to the horizontal position that causes the circular 'scoring' on the game disk. it happened mine last christmas, and GAME replace the game it had damaged.0
