My Xbox died on the same day it arrived, as I bought it over the internet from Play.com I rang Microsoft who admitted there have been quite a few faulty consoles but would only offer to repair and not replace it! I rang play and they we're great but I had to take a day off work for the courier to collect it. I'm waiting until the hardware is redesigned internally (a common process as consoles get older) to sort out all the overheating/crashing issues.
  • I'm surprised that Game would have told you that you have to go to Microsoft... thats completely incorrect.
"Disc burn" is unfortunately quite common, especially in consoles bought in the run up to Christmas. The console will need to be replaced.

At work if someone brings in a console and games with the tell-tale circular burn marks, they will be swapped over instantly. Don't even need the cables, controllers etc... and you should be able to keep your hard drive. The games can be claimed back from MS by Game, as its MS's not GAME's fault. Though as Game sold the console, they are seen as responsible to the consumer.
    Does that make sense?
If GAME tell you otherwise, they are talking poo and you should talk to the manager, if the manager refuses get them to check with head office!

You really do need a replacement Xbox, since it will just keep getting worse and worse. Especially as games are getting higher data amounts.

  • I'd take the xbox back to Game, and either get a refund, or replacement. And the same with the games.

On a side note, was there any red lights on the fromt of the xbox??
Also, did you move the xbox around whilst there was a game/disk in the drive?

A console of this age needs to go back to the store, however MS are pretty good at sorting fault 360's. They don't actually bother to repair your machine but instead send out a refurb unit, usually within a week turnaround.
  • thankyou all so much for the advice...

I am going to take the console back this morning and see what they say!

  • Hi All,
I have an xbox 360, which i got just before christmas. the hard drive stopped working last week, and when i phoned microsoft they simply told me they would send a replacement hard drive.
When i recieved the replacement (bearing in mind mine was pristine, and only a month old) i was horrified to open a scratched and chipped refurbished hard drive.
I immediately called microsoft who told me thats what they did,and refused to guarantee if i returned the replacement,a second replacement would be any better condition. I quoted the sale of goods act stating that a sub standard product could not be provided for a faulty product, but to no avail. We asked to speak with a manager, but the girl refused this request.
I'm very angry that my £300 console has developed a fault (and cost me money,in forcing me to buy a memory card so i can save games whilst this goes on) within a month of being bought, and that microsoft are giving me a replacment which is in fact older than my own fauklty hard drive. I am going to try taking this back to the shop i bought it from, was just wondering if anyone knew where i stood in getting this resolved by the shop. Surely microsoft are breaching the sale of goods act by giving me a second hand replacment rather than fixing my own,or giving me a brand new drive?I find it hard to accept that microsoft can expect me to accept a dirty, scratched replacement.

From what I have read this is what microsoft do... Even if you buy a brand new XBOX and it screws up with one of the known issues (overheating, Hard drive failure, Total system failure) they will send out refurbished replacements..
  • That seems very poor - if your sofa or washing machine was faulty you would not accept a dirty old one as a replacement for one that was a month old??

In my limited understanding it appears to breach the meaning of sales of goods act if not the letter of the law. But I am not knowledgable enough to know for sure.

My DS took his back today and got a brand new one as replacement. Good result as it is working fine, however I did clarify with the manager that if this second one goes wrong then he can get a full refund.

They would not however exchange the games - only suggesting that I return to the manufacturer, when I stated that the games were not faulty in their manufacturer or at point of sale so no fualt to the manufacturer. I also stated that I believed that they would send my DS away as it was the console that is at fault ie scratched the discs and not reading etc. Therefore his problem remains.

I have a question - where in the sale of goods act does it say that manufacturers are not allowed to exchange for refurbished items? I agree it shouldn't be scratched and dirty, but was just wondering, never knew, and many pages I visit about the acts appear different.
