Faulty XBOX 360

Hi Everyone

Please can you give me some advice???

My DS has spent all of his birthday/xmas money on a XBOX 360 last weekend. However it appears to have developed some faults such as freezing and seems to have scratched one disc and is failing to read another.

He has not moved the console since unpacking and setting it up so that cannot be the fault.

We have contacted the store where he purchased it and they state that the games will have to be claimed from the manufacturer..... This seems odd as it is the XBOX that appears to have made the discs faulty. If I had a washing machine that shredded clothes I would stand no chance going back to M&S asking them to replace my jeans and shirts??? I would be swiftly sent back to the washing machine manufacturer.....

Please can someone tell me what my rights are in this instance?

    I work at blockbusters & we were sent a batch of faulty xbox360 consoles which wesold & later custs returned them and we swapped them for fully working ones!
    And we swapped the games too!!

    I know one of the people that bought a faulty one was a member of staff and he contacted microsoft directly to complain so it may be worth taking this route as they know of the problem!


    I think that you'll prob have to get the games sorted via micorsoft if the store are unwilling to swap them where did you buy it from??
    Why dont you try contacting their head office/ customer services??

    I think I will take hime back to Game tomorrow but I just wanted some advice as to our consumer rights - I tried checking the government web site but it was not too clear...

    Technically speaking its the store where you purchased the xbox responsiblity to sort your damaged disc out.

    Don't let them fob you off telling you to claim from microsoft!.

    If in doubt contact trading standards and explain your situation they are only to willing to give help and advice

    With regard to the freezing of the console, is the console placed in a well ventilated area as if the console is in a confined space this can cause freezing.

    It was in a very well ventiliated area so not that .....

    I would like to wait until Monday to check with Trading Standards before we go back as I think the store will try to stick to the policy they quoted on the phone; that games must be claimed back from the manfacturer. However 16 year old DS is very impatient to the point that he is checking this thread on a 15 minute basis as he is desperate to go to the shop today!!! i have told him that I need more advice first but you know teenagers....

    What would happen if we took it back tomorrow and they refused the games refund, if we accepted a replacement and left would we jeapodise getting redress for the damaged games at a later stage following checking with TS or back here?

    Stick it out - If possible get a refund and shop at Tesco. I'm no fan of Tesco generally but have bought an Xbox360 and a Nintendo Wi on launch days from my local store. The 360 has been replaced twice without any questions.

    We got an xbox 360 last Jan from Game, it went faulity in December and we returned it to Game, they gave us a brand new XBox 360 with no problem at all.

    I thought Game had a 10 (or maybe 16) day return policy. It usually says on the receipt. If so, just pack _everything_ up, games, console and any extras and go in there to return them.

    I used to get a lot from Game in town but it seems to be a lot more expensive than elsewhere these days.

    Game can't exhange scratched disks because they get charged back from Microsoft, although it may come down to the manager, talk reasonably and they might exchange it out of goodwill.

    Oh, and the policy is 28 days as long as the item is unopened for a full refund, year manufacturing warrenty on hardware as long as you have a receipt or rewad card.

    Check that not only the console is well ventilated but also the power supply as this can cause freezing aswell.
