Who pays for a funeral if you have no money?

    AsknAnswer2 - when you say "enstranged from the deceased", do you mean partner/wife/husband etc? Or can sons/daughters consider themselves enstranged from their parents? For example I havent seen my dad for 20 years and have no intention of doing so. I can't think of nothing worse than having to be responsible of his funeral costs.

    No-one can force you to pay for his funeral. If he doesn't leave enough money to pay for a funeral and no-one else comes forward to pay, the local authority will take responsibility for the body.

    mmm. if the council think the family can fund it they will chase the family for the paupers funeral. not really the best way of dealing with the remains of a loved one.

    No they cannot; they can only recover it from the estate of the deceased, or from a person liable to maintain the deceased immediately preceeding their death - they cannot otherwise recover it from the family's personal funds.

    Preep - 'estranged' can apply to members of the family. The term is not defined in law therefore it is given its everyday ordinary meaning.

    No relative can be forced to pay for a funeral unless they were liable to maintain the deceased immediately prior to his death. (husbands/wifes maintain each other and parents maintain children).
