  • I heard about this before it went to the press on the consumeractiongroup as the person is a member, did seem odd at the time but quite funny in the paper

    This has made me think again about the advice of giving the banks registered address for the court stage. It is good advice to do this for court claims, but seeing as it is very big companies we are talking about, I think that putting your local branch as the address in the court papers could have an advantage if you want a chance to see the bailiffs in action.

    The address you put on the court papers is the address that the bailiffs will go to if it gets to that stage. Because this is banks, for sure there is enough property in the branch the bailiffs could seize.

    I'm thinking that your local branch would be as good as putting the banks registered address for the claim.

    In there there is a great article about a fella who got the courts to send the bailiffs in to the RBS to claim back £3500 in illegal charges.

    It's well worth a read - there is a summary of what to do and what to expect.

    If they don't defend and then claim "sorry we never received the paperwork" then they will have to hear the case again and it will take time and money to do all over again then the bank will end up settling before it ever gets near the court anyway...

    Royal Bank of Scotland has confirmed that one of its branches has been visited by bailiffs after a customer won a court judgement over more than £3,000 in overdraft charges. Declan Purcell challenged the overdraft penalty charges on his business account. When he got no response from the bank he took out a small claims court action, which the bank failed to defend. RBS paid up after the bailiffs' visit.

    Serves them right.......would have loved to have been a fly on the wall for that one though ;)

    Your local bank will send the claim to head office if it is for a lot of money. but I would love to send in Baliffs and be a fly on the wall. That realy would tickle my fancy.
  • i would have got on to the balif ppl ask when they were planning to go in and got the local rag to cover the story branch staff hate nothing more then being made to look like t**s
