    i certainly wasnt out to offend anyone but it makes me mad that everything they sent in their reply letter was utter nonsense and did not happen that way,

    They probably get dozens of complaints daily where they feel exactly the same way about the person complaining.

    They didnt call you liars. However, you could not prove your accusation. That is no different in most areas of law.
    I remember everything that was said in the conversation at the time and it wasnt the way theyve made out .

    I have had a complaint against me in the past where someone was forceful in their view that I had mis-sold them and they had perfect recollection of what I had said and what I did. Problem was that the date the product was sold I wasnt an adviser and indeed wasnt even in financial services as I was still in eduction.

    Where there is no obvious wrong doing, then documentation is king. Verbal accusations of what was said (by either side) carries very little weight unless it can be proven or one side has been seen to be inconsistent in their response or is not believable. Template letters can damage you in those cases. i.e. you list 10 reasons, some of which dont apply but are in the template. The firm can prove that 5 of those reasons are made up/false or lies. However, they have no evidence with the other 5. If you have no evidence either then on the balance of probability the firm should reject the complaint as you have been found to be unreliable at best trying-it-on at worst. (use of the word "you" is not aimed at you personally).

  • I agree Roonaldo. The "secure job" argument is a nonsense. The purpose of any insurance is to guard against something that is unlikely to happen.

    If it was likely to happen then no cover would be provided. That is why PPI complaints that pre-existing health problems made them ineligible tend to be upheld.
  • I claimed Black Horse for mis selling my mum and dad PPI insurance,the usual they were told they wouldnt get the loan if they didnt take the insurance.the insurance was useless they wouldnt pay out when my dad was made redundant they both had to find the payments for 6 months,fortunatly my dad found another job.At first my mum went to an ambulance chaser firm off the TV ( NO WIN NO FEE),they were useless dragged on for a year then a measly offer of £2600,but the best bit was Black Horse would take it off their loan..FAT CHANCE,this would have meant my parents would have to pay a third to the crap solictor out of their own pocket.Thats when i took over,quite simple sent Black Horse a nice letter that we we rejecting the offer and the solicitor was no longer dealing with the claim..I was.Then we took the complaint to the Financial Ombusman,letters came and were posted back once again with all the details misold blah blah blah,this lasted for 6 months,but i kept on their backs every 3 days i called their offices,think they got sick of it.Last week a final offer of £11,000 pounds which includes interest.This goes to show there is light at the end of the tunnel,please dont use the companys that promise results,they take a third of your money for something that you can do yourself .If you need help contact the Financial Ombusman they are fantastic and guide you through the process.:j

    Still working to get all the info for my black horse claim-7 loans all with PPI some covered by FOS some not-awaiting full SAR info (had one incomplete reply awaiting the rest).
    So not as far on as the others on here. TBH the FLA seem to be a waste of time so its either FOS or court.
    Not to say anyting about this forum (its great), but if you are looking at court action I wuld go over to the CAG forum. They are a litigeous lot over there and many have gone to court and won against a number of companies.
    Trouble is the costs are higher and you have to be on the ball at doing the paperwork and understanding the legal arguements, but it will be quicker and if you win likely to get a bigger payout with none of this we are holding it against other debt rubbish.

    FOS is free and they do all the work.

    If you go to the FOS and you don't like the results you can still go to court, but if you lose in court thats it.

    Good luck to ev1 whatever route they take. I am thinking of asking for all to be looked at as one by the FOS if they all get refused, i reckon they would then have a good reason to push for the ones not covered by them under the same discussions.

    If they still refuse will go to court and use any info tha results from the FOS investigation against them.

  • I suspect Black Horse feels its position is strengthened by this.

    It will certainly make taking somebody to court over PPI more risky.
  • After recieving 2 not upheld letters just received an upheld one ,very strange ,all 3 were for the same reasons but only one got upheld ,cant complain ,also just received a letter from lloyds tsb upholding my claim ,so just over £10,400 so far ,thanks for all the advice on here ,i would never of claimed if this wasnt here !
  • I've sent my complaint to the FOS against the underwriter Genworth Financial and a seperate complaint to the FLA against Black Horse - after receiving a copy of the agreement the insurance was £1502.68 amounting to £1892.40 with interest. I'll keep you posted!
  • Hi Valers, I am in the same position as you, they sent a rejection letter which I retorted with annother stating that I disagree with there decision and annother list of reasons why in more detail this time. The have since replied sending a questionnaire along with it. Im not sure what to do next, do I return the questionnaire on its own and wait for further rejection or do I put in a covering letter ramping up the pressure??? any advice letter templates would be most appreciated.
