Hi,my husband recently got rejected for mis sold ppi insurance ,theyve said it was explained to us at the time of sale and we could of cancelled it within 30 day ect ect ,all rubbish ,we were told at the time that we had to have it and not once was it explained it was optional,he also had a secure job with 6 months sick pay ,do you think its worth asking them to look at it again or will he be wasting his time ? thanks in advance

Yes write back and give them another 14 days, tell them you do not agree with the decision they made, and request some written evidence they had to reject your complaint, give them any further details that apply to you if you can.
What year was it taken out?

No such thing as a secure job and 6 months sick pay is on the light side.we were told at the time that we had to have it and not once was it explained it was optional
Supply them your evidence of that and you will have a very strong case. if you have no evidence then it is just a verbal accusation and quite easy for them to reject on that basis.
Did you have any other reasons for complaint?
Most complaints that get upheld are either due to ineligibility or single premium with interest added to or just plain luck because the lender is swamped with complaints and is upholding everything (mainly a few banks but not most others). I received a 'defend' letter from BH saying basically that I'd 30 days to cancel the insurance policy. I wrote back to them asking them to review their decision and enclosed some additional paperwork that i'd found. The 14 day deadline I'd set passed so I rang them to discuss my complaint. What a brick wall that was!! They denied receiving my letter and the advisor told me that even if they had received it they wouldn't respond to me as the defend letter was their Final Response. I asked them to write to me confirming it was their final response so I could take the matter to the FLA (as they weren't regulated by the FOS in 2003) and the courts if need be.
Meantime whilst researching how to take the complaint to the FLA I saw this statement on their information page Please note that the FLA cannot award compensation or make a decision about your complaint. I rang them to ascertain if this meant that they would not make a decision on whether they thought I'd been mis-sold PPI. They sadly confirmed this was the case.
I'm now going to take make a Small Claim Application through the Scottish Courts. Has anyone else out there taken this step? Any info would be much appreciated.0 -

Thanks for posting. I've read some of your other threads over the passed 4 months and your advice is impressively informative. My dilemma now is whether I should proceed with a complaint to FLA or make a complaint to the FOS who said would consider the case if I lodged it against the underwriter Genworth Financial.
Recently the BOS refunded me £3300 and the applications to both lenders were practically identical.0 -
You could do both.
In the first instance, I suggest you find out (from FOS) whether the underwriter subscribed to the GISC code at the time the policy was taken out. If it didn't then FOS has no jurisdiction.
If it did then you have a complaint that it breached the code by accepting the business from Black Horse and, but for that breach, you would never have taken the policy out.0 -
On a connected issue, I've noticed something interesting with BlackHorse. I've made two complaints to them, about two loan PPIs sold in the same way at the same office.
The one which can be referred to the FOS has been upheld and I've been promised a refund. The one which cannot be referred to the FOS has been rejected.
Needless to say I have objected and asked them to clarify why they consider one to have been a missale and the other to have been fine.0 -

this bugs me, people say on this website about how secure their job is but unemployment has just hit a 17 year high. where I live the councils are making hundreds redundant and police even made redundant. like what dunstonh said, no such thing as a secure job. this is what insurance is for.0 -
Hi and thanks for the advice,when i said "was" i was just talking about the time the loan was taken ,infact hes still in the job and has been for the last 18 years ,i know that jobs arent all that secure and i certainly wasnt out to offend anyone but it makes me mad that everything they sent in their reply letter was utter nonsense and did not happen that way,but at the end of the day its their word against ours but i just dont like the way we were made out to be liars and they were the saints .I remember everything that was said in the conversation at the time and it wasnt the way theyve made out .0
