  • 3mm is 1/8" in real measurements, hardly a spike.

I cant believe the OP didnt see the 3mm spike !
  • What if that post had been a child?
Correct me if I am wrong, but I don't think that local councils are allowed to employ children to guard lamp posts these days.

You are wrong. In this area, kids are frequently chained to lamp posts to act as guards. They're issued with mobile phones to report any incident directly to the police.

Don't they do that in your area? You must live in a posh place.

While reversing my car into a parking space this week, I failed to notice a small pillar at the back of the space that was protecting a lamp post and managed to nudge it. My bumper is quite flexible and I noticed pretty quickly that I had made contact with the pillar so wasn't too worried that there would be a significant scratch. However, when I looked closer, I noticed a small spike of about 3 millimetres sticking out of the pillar which had made a deep scratch into my bumper. There was no other sctaches on the bumper other than that.

Do I have grounds to claim again the local authority who manage the car park? While I accept responsibility for nudging the pillar, the pillar should not have had the spikes sticking out as it did. Is there a ‘duty of care’ here?

    Thanks

Just out of interest, how did a 3mm spike cause a deep scratch?

On a personal level I find it odious that you want to have other tax payers fix up your car because you are an incompetent driver but that's by-the-bye.
  • hahahahahaha. Oh, you are being serious, OP?

I think the council should sue you for scratching their post which was clearly minding its own business.

Sorry OP, get on it with the T-Cut and watch out next time!

I once had a customer who asked if he could claim for damage to his expensive alloy wheel after hitting a pot hole. I said you may stand a chance if the council were aware of the pothole.
