He needs to go to the CAB and get a welfare rights adviser to write the appeal for him - they will be able to get the appeal back dated and then can ask for exceptional circumstances for the tax credits to be back dated as well.
He needs to get an emergency court hearing (ex parte if possible) to get the child returned to him, as she is blatantly flouting the court order. If the child has a social worker then this SHOULD have happened already, as there has already been a decision made that the children are not in a place of safety with the mother.
Unfortunately the CB dept are a law unto himself so he needs to show that he has parental responsibility and that the children are registered to his address, the address that they are registered to for things like the GP, school etc are his address and coupled with the court order that should be enough evidence. I will warn you this will probably take several more months as the CB dept are obliged to write to the mother and ask if this is the case, they then have to make a decision.

Well...... its finally over for us. Had a phone call yesterday to say that child benefit has ceased and therefore we have to make no further csa payments after this Wednesday.
It has been a roller coaster of a ride over the years and I have had many a tearful conversation with the csa who even had to call me back on one occasion as I was sobbing on the phone with frustration over their system and incapable staff.
I really hope that you all get things sorted and please remember that it is not always the dad that is in the wrong.......0
