    I couldn't help but smile at the predicament you're in. My advice is to report your OH's ex via the targeting fraud website. It may sound extreme but it is benefit fraud after all. I can assure you it would be kept confidential and it works. Child benefit is the easiest benefit to defraud but in this case if it is proved it will be backdated and the child support will also be retrospectivly reassessed and any money you've paid to them will be refunded to you.

    Good luck though, the CSA are rubbish at dealing with anything but fraud is fraud no matter who does it.

    Also to the people who blame the child, stop now, the mother knows that she's not in college so she knows she's commiting benefit fraud.

    Just posted a reply to the main thread and saw yours.
    I advise you to do the same but quote this in the fraud referral.
    'When a child fails to stay in the parents home for 56 consecutive nights they are classed as no longer qualifying for child benefit'. This is a rule that many people are totally unaware of. Even CSA staff will claim not to know anything about it but child benefit staff are fully aware. The fraud referral will bring it all out. Just give them all the details and wait for the outcome.
    This happened to me and I claimed over £1000.00 back. i no longer have to pay anything.

    I have reported her for fraud on the special form on the benefits website and have had an email saying
    "Thank you for taking the time to contact us we will be in touch within the next 4 weeks"
    I did this once before back at begining of September and still have heard nothing.
    It is infuriating but good to know we are not alone on this.

    If the "child" is definitely not in education but is working, then if that was me, I'd just stop paying (assuming it's not a DEO) The CSA will soon get on to you about it, then just tell them the situation, and that you have reported her for fraud!! But I certainly wouldn't continue to fork out, and as she is committing fraud, she is unlikely to complain to the CSA that you are not paying!!

  • contacted child benefit office and they have said they will continue to pay child benefit until December or when the fraud dept get round to checking and there is the possibility that they will continue to pay child benefit even longer if they want to see if the mother continues claiming fraudently. Csa said all they can do is request another check.... It could go on for months but app we will get any over payments back!!! at some point.....

  • My boyfriend ended up with his 2 kids when his ex tried to kick the door in his house and got charged and locked up for weekedn. When police came and interviewed everyone it transpired that his ex was neglecting the kids and was told by police that they will recommend to social services stay with him until this is sorted. Once socail services got involved they advised him to go for custody of the 2 kids (as they never married), the kids refused to go back to there mum and wanted to stay with there dad. This continued and ended up incourt with her having 2 days per week visitation rights. In the mean time he was told to apply for child benefit and tax credits which he did. It took 5 mths for this to sort its self out only for her to put in another claim in July and his benefits stopped. He supplied all the court information solicitors letter ect to say she only got kids 2 days per week. In oct he was told a decision was made in her favour and she was awarded all the child benefit . NOw on 24th sept she refused to return 1 of the kids while the older one ran away and had to get her dad to come and get her. His ex is gettign child benefit for 2 kids when she only has one now and his tax credits are stopped as has made a claim from august, when she only had 1 child, which she basically snatched, sincwe sept 24th. There is another court hearing in 2 weeks, is there anyone who can give him some advice on how to firstly get whats owed to him back and how he can get the DWP and HMRC see what she has done is wrong. The only helpful one in all the is the CSA beleive it or not. Thansk in advance for any replies

    Go to the papers...!!! It is ridiculous, that this can happen...!!!

    I would also consider a complaint against the police if they where involved in the abduction after custody was granted, as it is abduction...! And they should of not allowed her to keep any child if he has custody...!
