Can this really be a free car?!?

  • You should think through why someone would just abandon a £1500 asset and perhaps get as much information about the owner as you can from the property owners.

    Now if you found a ring on the street and gave it to the police and no-one came to collect it, after some time, is it 6 months, it would be yours. Does this apply in this case ?

    I'd expect the police to recover the car from you once he reports it stolen and proves you applied for the V5 whilst he was abroad then took his parked car away. When you admit you took his car, I can see a very real chance of being charged with the theft of said car.

    That's the legal side. Then there's the chance of him going round your house with some petrol and matches to think about. Claiming his car isn't something I'd be thinking of doing.

    I don't know that, however, letting company own all the houses on the street, only 4 houses use these parking spaces, and neighbors no nothing about it.
    If the car was on the public highway, it would have been crushed by now, due to the lack of tax and insurance. I expect there is no mot either. The car has been abandoned in my opinion, and various attempts have been made to contact the owner. The landlord, and property agent wish me to dispose of it, ASAP.
    I feel I have justified the removal of it, however, I don't know if I could keep it? Or even sell it?

    Register it in your name, take a logbook loan out, then sell it for £250 as spares only on ebay. The debt will magically disappear and you wont have to do much work !

    If the owner re-appears remember to charge them for storage from when the previous tenant left.

    Maybe he took out a logbook loan before he left the country !!!

    I would "move" it to the public highway and it should be collected and crushed in good time.

  • If V5 does not = ownership, then what document does? How would someone go about proving they are the owner of a car?

    I'm with him ^
    Though I guess if someone can prove they owned the car by way of tax/insurance payments etc, then the DVLA could backtrack and then find out that they gave the car to someone else (via the V5) rather than the previous owner transferring ownership themselves.

    Though it might be worth a punt:
    Does anyone know any rich people that are about to go on an extended holiday? I'll just wait for them to go, then tell the DVLA that the Bentley has been abandoned and I'll be happy to take ownership ;)

    A receipt for its purchase proves ownership. The OP will not have this.

    V5 only declares the registered keeper not the owner.

    The landlord has legal obligations to consider, it should be treated the same as any other property thats left in a rented house. The landlord cannot just give you the car because its in their way, they have a duty to keep it safe.

    I would say if they've followed the guidlines in the above link I would ask them to provide you with a receipt detailing the steps they took to contact the owner and copies of all letters they sent to the owner, and that they have signed over to you for disposal. It will make things easier if the owner comes back later trying to claim it.
