My partner has a mortgage account with the Bradford and Bingley and has been charged a £25 monthly admin fee for being in arrears over the last year. He is about to pay off his mortgage. Will he able to claim these fees back?

I have just claimed back £550 worth of charges from the Halifax using the Bank Charges template letter. As far as I'm concerned its the same premise. Go for it. If you don't ask you don't get. I'm sure Bradford and Bingley will roll over rather than have the law tested.0

I have been with Bradford and Bingley for many years where originally My wife and myself held our Mortgage that is no longer the case and the account has been used only for paying in my Pension and paying out of several Direct debits/Standing orders, due to a house move recently and a letter sent to my pensions department (local firms Medical pension scheme) I am Medically retired, for some reason they never received that letter and consequently the yearly form they send out to verify whether you are dead or alive never was sent to me to get filled in and due to many things going on I had over looked that this Form for the first time in 8 years had never turned up, so onto the problem, because of this my Pension was not paid into my account and three D/D one of which is for only £10 was never paid a letter arrived a week later from Bradford and Bingley (after the damage was already done) telling me what had happened and that £75 was going to be taken out of my account for Administration charges in fact one of the D/D has already been resent back to BB (their policy after 7 day's) so as there is still no money in the account that will be a further £25 charge added on!
I have contacted BB to try and waive these charges and they simply did not want to know even given the circumstances that it was not "completely" our fault my Pension department is sending me a Priority cheque within the next 10 days so that is not a Issue and I understand that it is not their fault either, but because of the way my wife and I have been treated by BB I feel like closing down the account altogether (I have a Bank account) do you think it would be better to keep the account open if I start action in trying to reclaim any excessive charges from Bradford and Bingley, I am going to stop my pension and Cancel all D/D at BB whatever happens but I please want some advice regarding whether or not to cancel my account with them at this time? or would it be better to leave the account open while I start the claiming Procedure.?

this is a warning to anyone attempting to reclaim mortgage charges. this is not the same as bank charges and they will fight you. DO NOT take them to court. by all means complain and even take them to the FOS. if you want my reasoning i will answer PM's but not explain further here.

I recently sent a cheque (10.00 as advised in MSE) to Bradford and bingley for my old statements. They arrived less than a fortnight later with the cheque returned to me :j
I am going to try the next step and try and claim charges back. Fingers crossed.0
