O2 Upgrades?

I am an existing o2 customer with a Contract since Feb 2010.
Last week I went on the o2 site to look into upgrading my handset when the new iPhone 4s becomes available.
I went to a page which offered an early upgrade for a charge of around £95.
As there was no info on upgrading to the iPhone 4s I went to my local O2 shop and asked what I should do. I was told that they could not take orders early for iPhone 4s and that I should return to the store on the day of release and I would be able to upgrade then.
This morning I went online to check the details of the early upgrade but the page had gone. I went to the o2 shop and I was told that that this was no longer in place and that I would now have to wait until January 2012 to upgrade because my current contract payment is 'ONLY' £35 and only customers who pay over £40 a month are eligible for early upgrades.
I phoned O2 afterwards to ask if thre was any way around this and was told I could upgrade to a £40 contract but would not be able to change my Tariff for 12 months. I was then told I could of renewed my contract last week, paid the £95 charge and waited For a new iphone 4s handset. But the tariffs for iPhone 4s weren't announced until this week so how would this be possible? I was also told if I did pay off the remainder of my contract I would not be eligible for an iPhone 4s as this is only for existing customers and renewing would make me a new customer!
My latest bill was £39.36 but obviously O2 now feel that I am not as valuable a customer because I am not contracted to Over £40 a month!
I have made a complaint to O2 as I am not happy with what has happened, any advice from anyone as to what I could do to get a new iPhone 4s now AND stay with O2, only because i have been led to beleive they are the only reliable network in my area.

It is hardly 'unfair' - your contract is simply a deferred payment scheme for the desired handset, if you don't pay the correct amount, you don't get the goods. If you already have the 4, you'd be much better waiting for the 5 to come out next year, something that will be denied to you if your original plan to upgrade was successful.0

Buy a new 24x£41 contract with a 'free' 16gb iP from 02 as a new customer (or any other contract available).only because i have been led to beleive they are the only reliable network in my area0
