02 have stolen £30 from my bank account!!

Hi,

Im looking for some advice on what to do really and to vent my anger!!!!

02 took £30 from my bank account...I havn't bought or ordered anything so I queried it by email. They asked for a copy of my bank statemant as proof that they've taken money..so I faxed that off to them. They emailed back saying they will credit my 02 account with the money..no apology or explanation as to why it was taken in the 1st place  ...
....the thing is..I'm not paying for my line rental at the mo (when my contract was up last year,as I was such a good customer they said I had built up enough loyalty points to pay for my line rental for a year if I stayed with them)

So for them to credit my account with the money is no good to me atall as Im not paying them anything at the mo!....So I emailed back and asked them if I can have the money put back in my bank account instead.....they say no....I email again a little madder..telling them that as a result of them mistakingly taking the money from my bank account,I am now overdrawn and getting charged interest (TRUE!) ...they email back saying yes ok but it will take 21 working days!!....Then Ive recieved another email from them today saying that they won't put the money back into my bank account, they've made the adjustment on my 02 account!!!!!! (WHICH I DON'T USE!)

What do I do? Can they legally do this to me? Don't they have to put my money back where it was taken from?

Any help will be gratefully recieved and I'm sorry for the long rant!

  • hi, they did a similar thing with me last year, they took money which they shouldnt have and i contacted my bank who filed an "indemnity claim", as part of your direct debit agreement you can take back any money you think is wrongfully taken by them.
The money then usually gets put back into your account the same day or 24 hrs later.
Of course after a while O2 will contact you about it, but if you explain to them that they shouldnt have taken it in the first place, they shouldnt have a leg to stand on.

    Hope this helps

    From (another) Helen :)

    Hi,

Can I claim the money back and get it put into my bank account, even though theyve paid it back to me already (in my 02 account,so I can't get to it!!)

I won't be taking another contract up with them when the time comes so the money in my 02 account really is useless to me!

Try firing a strongly worded email off to complaintsreviewservice@o2.com I would imagine that will get it sorted.

You are entitled to the money back either by indeminty claim or by direct refund from O2. DONT TAKE NO FOR AN ANSWER!!!!!!!! And you want compensation for any interest you have paid as well as the incovienince.

    Good luck
