how would i go abouts writing / wording the appeal letter with the missing information from the back of the pcn. shall i print the page of the act out highlight the missing sentence and make an appeal on that ground that the pcn is flawed therefore not valid gong by the act ... is there atemplate i could use and also do i include that the reason i parked there was due to my disabled father in law and that it was an honest mistake. thanks0

Yep, do just as you described.
If you copy & paste just a small part of the missing wording into Google and add 'pepipoo' as an extra keyword you should find results that show you other threads where people have drafted an appeal based on the same flaw. Copy their version but it's really just a case of putting a letter around the quoted flaw.
You do need to know that most people win when they appeal all the way to adjudication - but that you will no longer be able to pay the discounted penalty once you get past the NtO stage. It will be 'all or nothing' so make your decision now whether to fight or whether to pay the lower amount. It's your money so it's only fair that you know the situation. And be ready for the Council rejection letters at first, it's all a game of bluff to them!
Having said all that, personally I would 100% definitely appeal ANY Council PCN all the way to adjudication now that I have seen so much on pepipoo over the last 3 years on there. I once paid one about 8 years ago which I now know I would have won at adjudication (yellow line with no sign). Never again.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

thanks gona get started today. I've been reading the MacArthur vs Bury Council and the pcn was cancelled due to the missing date. can i quote that case and go along those lines. there are alot of cases similar to the technical points missing off on pcns and they have got the pcn cancelled - have u heard of the loophole lawyer in america he gets celebs off criminal charges
do i still need to get a tro/tmo from the council.0 -
Always a good idea to email for the TRO as there may be errors with that as well - maybe the bay times don't match the signage, that sort of thing. Just ask for the order for that road, without mentioning the PCN (maybe use a different family name and email addy). That way they cannot mistake the request for an 'appeal'PRIVATE 'PCN'? is some information mssing on the back of the PCn which should be on it so PCn is flawed .... Just looking it up now
found it...... It does not say that "those representations will be considered"
As stated in the civil enforcement of parking contravention England representations and appeals regulations 2007
therefore the PCB is flawed and maybe on this note I could appeal.
right going to write the appeal letter now but what does"those representations will be considered" mean exactly ... for example what is the implication to the council if this information is missing on the back of the pcn. as on the back of mine it says.... "all cases will be considered on their individual circumstances" isn't that the same or the wording has to be exact? also doesn't it mean that the council will be more leaneant( not that they ever are just after money)
argh just so confused in my head..
