It may work out cheaper to just pay the amount Orange want if it was a ultra a high mobile, then again it work in your favour to apply the above and enforce it under Unfair Terms in Consumer Contract Regulations 1999.
I'm not sure any of this is valid, the OP broke the contract by not paying before trying to get out of the contract, and the Ofcom is for landline not mobile providers.
Can you claim under the unfair contract terms after you've broken the contract, rather than before? The OP is already at fault rather than seeking to get out while the contract is in place so I suspect thats a judges decision to make.0 -

Why's that ? Ofcok reference Regulations that can be applied to ANY contract, telecom or otherwise, taking the "mobile" handset cost away from the total due to Orange there is scope for the line rental/allowance not provided by Orange to be reduced. Simples.
Read with no legal knowledge and your correct "What your saying just doesn't apply", when it really legally does

Yes they have passed the recovery agency so I know they wouldn't entertain my calls.
I understand a contract is contract and I've to pay no denial about that. However ain't they bound by the same contract to provide services for the full term if they want the full payment? They disconnected services and now they want full payment for the services which they didn't provide.
Let's see how it goes, I'm going to drop them mail with the same explanations. Will keep updated.
Did you get a "free" phone with this contract? If so most of the contract cost will actually be repayment of the "loan" to buy the phone, not the airtime.0 -
It sounds to me like Orange's common sense kicked in after your first failed payment.However a common sense kicks in which says why to pay for the services which you didn't get.

I don't think so in this case.
The OP had already defaulted thus breaking the contract before any of this happened. Orange were in their rights to ask for full payment in such a case as the OP frustrated the contract.0
