May have been caught speeding

Hope some one can help as I am confused. My husband returned home from work today and he thinks he was speeding? He was driving the van along a stretch of motorway that has been reduced to a 40 due to roadworks. All was ok and he was obeying the 40, he then took the slip road off the motorway which goes over the motorway and proceeds onto a normal road. He increased to 50 and then twigged that they still had the 40 restriction on even though this was advertised as only for the motorway?

He said there was average speed camera's so he will have been caught. Is it legal to have signs up stating that their are restrictions on the motorway but then find this applies after exiting the slip road but with no signs. i.e no 40 sign at start of slip road but a sign saying 40 near the exit if that make sense. Any help much appreciated thank you.

    I would have thought the restriction stands untill the local, or national speed limit is shown.

    Did hubby pass an average speed cam after the motorway ended/ slip road began?, if not no ticket.

    If the previous camera was a good way back from the slip road and there was 1 at the top, then again no ticket, they average remember.

    And lastly if he trully only drove up the slip road at an indicated 50mph, again no ticket due to the over reading of the speedo and the tolerance set into the system of camera use, 10% + 3mph being the accepted norm, so say 47mph. It's odds on his speedo will read about 4mph over at 50 so little chance of actually being over the threshold.

    That doen't mean he wasn't speeding of course, just that he won't get a ticket if you get my drift ;);)

    No point getting excited until you get a tcket. They have to post it out wthin 14 days.

    The speed restriction will apply until a sign saying it has ended, regardless of what class of road you are on.

    If this was near Dunfermline, it confused me on Tuesday.

    The Registered Keeper must receive the NIP within 14 days of the alleged offence (unless there are good reasons - eg a recent change of address, but NOT postal delay).

    i dont know if the plus3+ 10% still applies i was doing 56 in a 50 and got done for it

    Its not a law - parts of wales you'll get zapped for doing 31 in a 30.

    i find (usually) average speed cameras are pretty lenient, esp the ones on the A/M1.
    Anyone else try the hide behind a lorry trick when entering the first set of cameras :rotfl:
  • The average speed camera will be linked to the last average speed camera he passed on the same stretch of road, if he's just exited a junction then the first camera will not be linked to any of those he passed on the motorway, since it will be extremely unlikely that vehicles that have slowed or stopped at a roundabout will exceed the speed limit. More likely the camera he passed at 50mph will be linked to another further down the road, and the average speed calculated from when he passed that.

    I don't trust the gatso's below 70mph, best to stick rigidly to speed limits rather than tempt fate with a varied application of the 10% variation rule.

    A temporary speed limit needs an order to be applied for and the roads covered must be named, it is always worth sending for a copy of the regulation order to see if they actually have one, happened up here when people entering the m621 from the m1 were fined by an average speed camera and it turned out the order was for the m1 only so only valid to the junction of the m1/m621 and not beyond, as the second camera in the AVG paring was well inside the m621 a few clever folk sent for the order, so those who took the time to go to court and use the defence got found not guilty and those that did not got 3 points and a penalty despite it was well known to be operating without correct authority and legal order and remained that way for 18 months.
    The fact of such cases, is they don't need ANY evidence if you admit the offence.

    Yes you are spot on this was the place.

    It confused him, he was doing 50 as his speedo is out by 5 miles so he was sitting at 55 so it was 50.

    It's shame as we have never had a speeding ticket before and may get one due to total confusion.
