    also ask the council to confirm that bailiff Mr cohen has the authority from xxx council to levy goods on there behalf as he is not certificated to Rundle & co, and if his employer is now rundle & co to confirm the date of change to his certificate and the name of the court that authorised this change
    I am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

  • thanks hallowitch again, you've been a star with all your advice, just rang the bailiffs from my work phone - (recorded line) and informed them i am willing to make an offer of £70 a month, the girl on the other end of the line said she would need to check with head office and get back to me, but they would still need to come round to discuss this, so i said to her that they have no legal right to enter my property and no where in the Council tax (administration and enforcement) regulations 1992 does it state that i had to let them in, she then said well that is their policy and they have the rights

    They really want the extra fees don't they. Why didn't you stick to £50 as you said in your first post? You can still pay £70 if you wish but commit to a minimum of £50.

  • just did some rejigging of my budget and figure i could afford the £70 and this might get them to shove off

    It will make them more determined to get the Walking Possesion Levy fee and a Van fee when you miss a payment. Then the redemption fees when it's almost all paid off.

  • so do i just ignore them,as they have said they will come back to me with whether or not the offer is acceptable, that was around 2pm now 4pm nothing, my girlfriend is getting very stressed out as she is at home all day and worried they will just turn up

    your right there HappyMJ they seem determined to get there fees

    well done for recording the call If/when they phone you back tell them you Will pay by standing order only and inform them legislation overrides over THEIR policy
    I would also ask them to confirm the date and court where Mr Cohen changed his certificate to rundle & co as defined in The distress for rent (amended)rules 1999

    “Change of bailiff’s name, address, etc

    7A.


    (1) In this rule relevant detailsmeans a bailiffs name, address or other written

    information appearing on the certificate.

    (2) If there is any change in the relevant details, the bailiff shall without delay give

    written notice of the change to the issuing county court and produce his certificate (theold certificate) to the court officer of the issuing county court.

    (3) When a bailiff gives notice and produces the old certificate in accordance with

    paragraph (2) above, the Judge of the issuing county court shall issue to the bailiff a replacement certificate reflecting the change in the relevant details but in all other respects

    (including, without limitation, the date of expiry of the certificate) the same as the old certificate.

    Yes just ignore them. They will turn up. Thay have to turn up they are chasing a debt and don't just want £42.50 for it. They want more....lots more... You need to not answer the door and make sure the door is locked and the windows are closed. When the bailiff gives up the debt will return but you will have hassle in the meantime but if you do give in and pay them then you will be paying way over the odds for the debt. Unfortunately, now you have made contact they may just be more determined than if you had ignored them from the beginning. Give it a go and relax.

    I am also concerned you have made an offer that is too high. You said your entire disposable income was £80 per month, you said you do not go out and don't spend anything at all yet you need to get out of the house and do something which involves spending money. The £70 offer does not leave you anything at all for any emergencies or any going out money at all.

    I understand your girlfriend is worried but rundle will eventually send this debt back to the council

    did your girlfriend live with you in the property that the liability order relates to
    did you move into her house or did you move in together at the same time

    thanks again folks, i am happy to ignore them, just the other half is getting worked up over it, but know i have direct her to this thread, and the various websites dealing with bailiffs powers she is happy to ignore them and if they do turn up, she will talk to them via the letter box.

    no me & my girlfriend have only recently moved in together, i lived at the previous property on my own, i moved into her place
