Council Tax and Baliffs

Dorthy Hopper needs her xxxxx kicked she should not be telling debtors to allow a bailiff into there home there is nothing in legislation to say you must allow a levy on goods
send a FORMAL COMPLAINT to the chief executive of your council
Tell him that you have tried to make arraignments to pay this debt in instalments however the bailiff and Dorothy Hooper have both said you must allow the bailiff into your home to levy goods incurring levy fees before an arrangement can be made to pay in instalments
Ask him if this is standard practise for this authority not to allow a payment arrangement to be made without a levy on goods
Ask him to point where in The Council Tax (Administration And Enforcement Regulations) it states this
Ask him if this the advice she is giving all debtors
ask him to confirm this in writing
Tell him legally you do not have to allow a bailiff into your home to levy distress for council tax arrears tell him you will not allow a bailiff into you home you will however pay this debt at £xxx by standing order per month/week you don't care who you pay as long as its by standing order and on stated date
Ask for a copy of there complaints procedure
send a copy of her e-mail and tell him you are disgusted that someone working on behalf of your local authority sends out e-mails like the one you receivedI am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

I'd want to be complaining to the ombudsman with an email like that - downright inaccurate and rude. They cannot force you to let the bailiff in. It's shocking. I'd also be tempted to get it splashed across the national papers if it wasn't for the fact you probably don't need the publicity with everything else going on. Shameful. Absolutely shameful.

and send copies of this letter and of all other correspondence to your MP, local Councillor, Council CEO, Head of anything at the Council and just about everyone else you can think of and perhaps Dorothy will be sent off for 6 months for some retraining, she certainly needs it!Loretta0 -
Quick update - got up at 6.30am only to find a letter from the bailiffs through my door
"we have attended today with reference to the liability order, which has been issued in respect of the upaid Council Tax due to South Gloscestershire council.
So far we have not been successful in seizing your goods and chattels in respect of the above debt, However, this does not mean that we will contiune to be unsuccessful. your actions leave no alternative but to call at your premises unannounced with suitable transport in order to seize and immediatley remove your goods to public auctio. the cost of removal contractors and auctioneers will be deducted from the proceeds of the sales of your goods
We trust that will make this drastic and expnesive course of action unnecessary by contatcing our offcie immediatley.
In case of hardship we may be able to enter into an arrangement for you to discharge your debt over a short period of time
your faithfully
James Cohen

Most local authority's do NOT allow there contractors (rundle &co) to sub contract out work on there behalf
go on to your councils web site and make a freedom of information request
Does xxx council have a contract with rundle &co if yes please provide a copy
Does xxx council have a service level agreement with rundle &co if yes please provide a copy
Does the contract /service level agreement provide for rundle &co to contract out the collection of council tax arrearsI am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites
