New TV and TV Licensing

My friend bought a new TV out of Tesco and let me use my own club card to get the points since she did not have one. She paid for the TV using her debit card.

Tesco never asked for her home address for the TV Licensing which I thought was strange until today...

I got a letter from the TV Licensing saying I need a licence to go with my brand new TV from Tesco. I can only assume they got my details because I scanned my club card. Since I don't have any legal duty to reply to the letter stating my circumstances, I just bin them.

However I don't feel it is right that they assume I bought the TV just because I used my club card to collect points that would otherwise go wasted.

Is it worth writing a complaint to either Tesco or TVL? I understand Tesco has to share the address of the owner of the new TV with the TVL but I didn't even purchase it and Tesco didn't bother to ask for my friends details.

TV Licencsing will probably not respond simply due to the sheer number of complaints they get in on a regular basis from issues like you have raised here and also from the way in which they hound people on the phone for being a day late with a payment on the card payment system.

Tesco's are instructed to on each and every single tv sold to pass on details to the Licensing people as is any other retailer that sells tv's it does make you laugh when you hold a licence buy a new tv and the thick idiots send you a letter saying you need a licence, hello dumb people at tv licencsing do a little research on the address before sending out your rather rude and intimidating letters.

I simply phone them and tell them they are thick idiots check the bloody postcode and now send me an appology letter, they never do this I cannot understand why ?

You can check the current terms and conditions but it used to be that the T&Cs were that you can only use your own clubcard to earn points on your own shopping.

Therefore, by using your card it either is your shopping or you are in breach of the terms of scheme and presumably therefore would forfeit all points in the account etc.

Now obviously you wouldn't be doing anything naughty like that and so it must be your TV and hence the TV licensing people have been told so

Surely not. This means that when my old mum goes down Tesco to buy me a steak pie for my tea and puts it on her clubcard she is breaking the T&Cs. What happens when a woman buys food for all her family or some comics for her kids? Suppose I buy a box of chocs and a card for someone else? In my book that is no different to buying a TV that is not for you.

Either you, or Tesco, has got this one wrong.

its to save filling in forms, if they didnt get the details from clubcard they would have to make you file in a form.

By all accounts they are getting rid of this stupid requirement for companies to sell TVs to tell the BBC (TVL is simply an alias so they can disconnect "Auntie" from the nasty door hammering goons in anti-stab vests they send round).

If you don't need a license ignore them. If they send someone around don't speak to them, close the door and do NOT sign anything.

In all those scenarios, the person paying for the items is the person collecting the points, which would presumably be fine.

With the TV scenario above, the OP's friend paid for the item with her debit card but the OP collected the points. Assuming InsideInsurance is correct, that is a breach of the Tesco Clubcard T&Cs (I have not read them myself).

I am not saying it's a moral point (I couldn't care less who collects the Tesco points), but if it is in breach of the T&Cs it is probably worth the OP keeping quiet about it to Tesco.
