Are you a wind up merchant or just extremely stupid?0 -
I think that with the acknowledgement of the cable issue that's pretty much enough to get you gross misconduct, while i understand the argument of "well it wasn't just me" ultimately it's a pointless argument which i'm guessing you already know - that's not meant to sound preachy by the way, but ultimately that in itself was wrong and shouldn't have been done.
Ultimately it can still be mentioned that you wee under disciplinary when you left, you may be extremely fortunate, but even if you are i would sharpen up and start doing things by the book, i know it's a pain in the rear, but ultimately much safer & more agreeable than taking a shortcut for efficiencies sake and as you've seen that's not really all that good in the end for anyone.Retired member - fed up with the general tone of the place.0 -

Oh for goodness sake. He has been ignoring safety rules and stealing stuff, and he has, by his own admission here, been doing these things for ten years.
And cable doesn't get made redundant. Posts are. Although in this case, not. Treating your employers possessions as "redundant" and selling them is called theft in anyone's book. The bottom line here is that it wouldn't matter if the employer got the entire dismissal process wrong - winning a tribunal would result in a Polkey deduction equal to the award. And might just get costs awarded too. So the employer has not the slightest bit of incentive to encourage him to resign - the OP's chances of a tribunal are about the same as mine are of landing on Jupiter any time soon! Frankly, if they are willing to allow him to resign then all they are doing is saving themselves the trouble of sacking him - if he even gets a reference (which they do not have to give) then he would be entirely fortunate. If he tried demanding a pay off he is very likely to be shown the door and no reference either.0 -

Thanks for the detailed explanation. In that case, dismissal is fair in this circumstance.0 -
