How do I get out of this Ebay scam?

    Oops thats a bit harsh, I certainly did not think my post warranted this reply. I did say I should have done it differently, I thought I may have found others who have had the same sort of experiance.
    People know what to do here - if you don't send with insurance, yes, I fully meant what I said when I wrote "egregious".

    You didn't take your insurance situation seriously, so you can kiss goodbye to your money.

    As I said, I would have settled for £300 in order that the item got there properly.

    Back to the OP: what makes you think it's a scam rather than a lost package?

    My money is on it being a scam, of course it may not be, but it has all the classic scam hallmarks. Ebay may send the debt collectors after you but lets try and remember debt collectors are toothless, they can harass but not bite. Now the the courts are a different matter, if they take you to court, which they won't because they don't have a case, then if they won the bailliffs can bite.
    For anyone who asks why they wouldn't win, it's because the sale is between the buyer and seller, ebay may have their buyer protection rules but thats up to them and a private sale between the two parties has no legal standing with Ebay. Ebay made it this way by winning a huge court case with the succesfull defence of the conterfit claims by insisting they only bring buyer and seller together and have no control over the sale, it saved them hundreds of millions in claims by Tiffany, Dior etc.
    The downside is you will lose your Paypal and Ebay accounts but thats all, if you can live without them, then just ignore it and it will eventually go away.
  • I dont 'know' but my son said this may happen after I told him about the sale.
    I would never consider doing someone else out of money to 'get my own back'.
    I think naive may be my failure here, not bad or offensive. I can not afford to lose this money, and I do believe that sometimes the good guy can win, so I will try.
  • Firstly, How do we know you sent the phone?
    That in its self says to me alarm bells should have been ringing to you, of how do you track something of value. I wish I had seen your ad for the phone and emailed for you to send it to me and I would pay for it when received. Because to me its the same thing you have done. Secondly, How long between sending and the buyer emailing to say not received? The fact you got paid in the first place is not the first sign of a scam. Most never fund it to begin with a they use false funding. The answer to the second question is more important as delivery to the destination can take quite a time.
    I am with the others, you are to blame fully and as pointed out, you could have covered yourself and made slightly less rather than lose it all.
    There are ways you dont have to pay back but thats another story and not what this is about. The lose is down to YOU.

    The only way he can avoid paying things back is to have sent the phone to the buyer properly insured.

    Unfortunately it's now too late to avoid a dispute going through and no way to prove the buyer is scamming.

  • Much to my surprise the item arrived.
    I am happy to say I was wrong, but have learned a valuable lesson on more than one point.
    From now on I will never send abroad and have changed my settings, thanks to Soolin for that. And I will make sure packages are properly insured.
    Im sure some others also learned a thing or two here, about the insurance for posting phones, and that there is no tracking when sending to some countries.
    I must say that I was surprised at some of the comments here, I have always found this forum to be helpful and supportive, especially in comparison to the 'other' site.
    I am not a new member on here but had to change my log in as my kids had figured who I was and were able to see what I was asking about, not a good idea before Xmas.
    So its a big Phew from me. And thanks for the helpful comments.
