Car Park plus Ltd issued parkng charge notice

Hello, please can I ask some advise, I was driving back down the m1 south, and felt tired, I saw a sign which said. tiredness can kill, take a break,so I took the advice of the sign, and pulled into the Tibshelf Services which was about a mile after the sign. I pulled up, I went to sleep, I later woke up and bought a take away. I went to Wales a week later for a two week holiday, and when I phoned my Mum at home, she told me cp plus had sent me a parking charge notice, alleging that I was there for 5 hours and 30 minutes, so Mum told me of this, so without thinking anymore whether they are legal or not, I asked her to write a letter of appeal saying that I was tired and needed to sleep so I could be alert to drive any further and not cause danger to myself or other motorway users, she did this, and the company repplied, saying they wouldnt accept my appeal so have to pay up by the 17th. The photographic evidence was clear going into the carpark, but in black and white, but going out, the car claiming to be mine, the registration plate could not be seen as the lights dazzled it, so if that an error on their behalf? would they have it in colour, as I looked at the photograph on the internet as it said I could, and it was the same, and is the tiredness any grounds? thank you.

You will receive a few letters then they will go and pester someone else.
You done the right thing in taking a break, and as you have now found their appeals process is a sham!0 -
If I was PM, one of the first things I would get rid is parking limits for service areas because tiredness kills, and you don't have the energy to play with the automatic payment telephone line.0

We would have recommended not appealing for two reasons. Firstly this is a business and there is no human face, just a template letter wheeling its way to you at the click of a mouse - one ready to decline your appeal. Secondly, you don't need to "appeal" because doing so sends them signals that you acept their authority when infact you deny their demand outright.
The amount sought is illegal as it goes beyond losses. In future, avoid appealing because it gives them the extra headache of having to identify the driver but as it happens, CP Plus are tame and lame, will never take you to court and will back down after the second letter.0 -
Relax the chances of it going to court are less than the odds of winning the euromillions, and if it does go to court, there is people on Peeipoo whom will do your defence.0

You have given a silly amount of info on here - why? If it's just naivety then please delate your full name, facebook, email, car reg and scam fake PCN number!
For goodness sake just calm down and just ignore the whole scam. Have you read the sticky threads yet at the top of the forum? Have you seen the Watchdog video, have you seen the PPC letters thread?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Is this free this service do you know? as im unemployed, and up to now, they have caught my car reg on entry, but on exit, there are car lights on and a reg cannot be seen, and yes, they have charged too much, they want £50 or if I dont pay it in the 14 days, then £80, and the carpark was empty wile I was there, but a police car parked up for about 10 minutes a few spaces away, they have admitted on their website, that there can be occasional errors, so the camera not seeing the reg on exit with my lights on, I would call an error. If anyone wants to go to their website and look up XXXXXX and pcn ref 00000000000 please do, and look espessially at the exit photo which I mentioned just now, thanks for all your help, I await reply if anyone wished to comment further.

The chances of you going near a court are minuscule, [although its increased by putting so much personal details in your posts] stop taking this invoice serious. It matters not about your reg No or car being on CCTV images. It is not an official charge and carries no authority.
They are simply relying on you paying for a service they believe they provided. And you accepted, they are perfectly entitled to sue you for their losses, which in a free car park would be £0. What they try to do is say by parking you agreed to pay these charges. Did you??

ive done that now, thank you for all the help, is this motor lawyer does legal aid and free for motorists? as im on incapacity benefit, and if they charged, id may as well pay the fake pcn, but I mentioned to my Mum today that I read all peoples advice on here, and they all say leave it, she said, well, its your risk, because I dont want her having the stress of her son, ie me, getting these letters, and as Mum isnt up on the law, and she is the type who would just pay up to get them out or her hair, then isnt legally minded, so thinks that anything that sounds odd isnt legal, if you know how I mean. That's the so-called "business model" of private parking companies. They rely on many people's understandable ignorance of the law. That's why they dress their letters up to mimic council parking tickets full of misleading legal mumbo-jumbo. Just relax this will go nowhere near a court. As for "threatening letters" just treat them as you would any other junk mail.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0

When a company is given permission to build a motorway service area that have to satisfy a number of criteria, one of which is to remain open 24 hours a day.
It would be interesting to see if another condition is to provide a safe place for a motorist to rest during a long journey, and whether this stipulation allowed the company to place a time limit on parking in said safe area.0
