uncertainty over driver responsible for speeding

The registered keeper is meant to take all reasonable steps (reasonable diligence) to provide the ID of the driver. He needs to urgently request the photos (I think they don't have to provide them until after the 14 days or something like that - check on pepipoo - but most will if he explains). He needs to check the route, time, diaries, credit cards, fuel purchases etc. to try to determine who was driver. I think your post highlights the 'rock and hard place' that motorists find themselves in. Maybe your solution of 'someone just taking the fall' works out fine in 99% of cases, but that's not helpful the other 1% of the time.
On the one hand, identifying the wrong driver is failing in your duty as a relatively upstanding citizen who is 'reasonably diligent' . Or, worse, it's perverting the course of justice.
On the other hand, telling the truth in the case you genuinely cannot identify the driver is often treated with contempt and earns the RK 6 tasty points.

If you don't know for sure and yet you state it was definitely you; then you could be in a lot more bother if they check the photo and find it was someone clearly of the opposite gender. Attempting to pervert the course of justice anyone?

thanks for the advice guys...my father was genuinely unsure about who was driving - he and my mother had both driven down that particular route on numerous occasions over the past week, which was why he found it tricky to try and remember who was driving.
My father ended up going to the local police station to speak to them about it...they apparently told him porkies and said that the only way he'd get to look at the photo's was if the case went to court.
Turns out there was a number on the letter he got - police said to call that, my father did, they looked at the photo and it turns out it was my mother driving, so looks as if it's all sorted.

My mother's out in Africa at the moment, so wont find out until next week when she comes back...she's a total drama queen and last time something similar happened lied to me and said my father had been caught speeding, but if he'd admitted to it he would havee lost his license (due to previous speeding convictions), so he told the authorities that she had been driving without telling her...she got very uppity about it all with me, saying it had caused huge arguments between them, etc.
When this incident arose, however, it transpired that my mother had been driving (or so my father says, and to be honest going by their respective track records I'm more inclined to believe him), so quite why she was blaming my father I have no idea.
Regardless, I can guarantee that when she gets back this time there will be a big scene as it gives her another excuse to kick-off and complain about something...the photo definitely shows it was her driving, though, so I think I will just try and make myself scarce until the whole sordid business blows over!0 -
