uncertainty over driver responsible for speeding

hey guys,

writing this on behalf of my dear old dad...he just received a letter informing him that someone was caught speeding in his car, but he's unsure as to whether it was him driving on the particular date in question or his wife (my mother). Where does one stand if there's uncertainty over who was driving?

Apparently whoever was driving was caught doing 37mph in a 30 mph zone...my father claims it can't have been him as he knows where the police park to use the speed radar in that particular stretch of road so he would have noticed it, but like I said he can't remember who was driving at the time of the incident.

Hope I've been clear enough - just want to know where he stands re: laying blame for the incident and therefore who's liable to pay the fine.

Any help clarifying the matter would be greatly appreciated. Cheers!

    firstly what does he believe caught him, was it a fixed camera, speed van or police officer standing at the roadside?
    Fixed camera probably impossible to determine who was driving.
    speed van, if this was recording you face on it will have the drivers image.
    Police officer, they would have stopped you roadside, and not let you carry on driving ,unless he attempted to stop the driver and they continued onwards.
    I'm sure there is a new law out now that the driver has to state who was driving, this stopped company owners getting away with points etc when they state they didnt know who was driving at the time.

    the transport manager would have been liable for the points?

    I forget exactly who would be liable but stopped companies saying could have been any one of
    20 or so drivers.

    As far as I know there has been no tightening up in respect of companies. A transport manager/director/co secretary will not be liable for points. The company would be liable to a potentially rather large fine only.

    In respect of individuals, it is now more difficult to use the defence that you can't identify the driver.

    It always amazes me when someone says in effect they can't remember were they where and what they were doing at a certain time of day, when the exact time and place is written on the ticket.

    Call me suspicious but you have to be, it's the oldest attempt get out in the book, I even tried it once, couldn't tell them it was the wife driving as the photo clearly showed someone with a full moustache.:eek:

    I'd sooner take the points than the flak from trying to blame that 1 one 'er indoors.

    Danger here is a "failure to furnish" charge which is far more costly. The fine and points are far greater so it may well be better to find the "driver"

    You ask me what i was doing last thursday at !3:35 I would have no idea though. The only way i would be able to tell would be look up my diary and try and work it out from there.

    Not everyone has a pin point memory like you - whether its being old and maybe losing their memory to people who are extremely busy and have most days roll into one.

    Please dont judge people that you know nothing about. It's a horrible trait.
