new t-mobile contracts

I have taken a new 12 month contact with t-mobile at the weekend. I've found a much better deal saving me over £100 and I'd like to cancel. I thought there was a 14 day cooling off period. The t-mobile call centre keep telling me its down to the branch managers discretion and the branch keep saying no, no cancellation is possible - only exchanges are possible if the phone if faulty. Can anyone advise on my consumer rights. Thanks

  • Did you purchase from store? Legally, you do not have a change of mind return period for goods bought in store. In this instance, T-Mobile are correct I'm afraid.

    There is no 14 day cooling off - you upgraded your contract... yes? Then it's no deal. You are locked in for the duration. As a new customer, you might be able to cancel, but 7 days is around your limit, unless the network explicitly extends this.

  • buzby, it was a new customer contact in the branch not an upgrade . Also, its only been 1 working day so far. If i recontact the branch, what should i be saying to them, as my rights ?

    Well, legally (DSR) the cooling off period is obligatory only for distance sales AND unused goods. And it's 7 days, not 14.
    In your case it was a store and the phone was used (I think).
    So, this is up the the internal policy of T-mobile shops. I can be wrong, but I don't see any information on the website and I think they don't operate any cooling off period for in-store purchases.

    None at all, anything that T-Mobile chooses to offer you st this point exceeds your legal rights.
