Ebay Issue

My partner bought a pair of Reebok trainers through a seller/shop on Ebay. She had them for about 8-9 weeks then they developed a fault, "they have an air pocket in the sole which is supposed to be unbreakable" where basically one of them punctured.
She e-mailed seller/shop and told them of the problem, they in turn replied that they would need to inspect them, so she sent them off recorded delivery and they were duly delivered and signed for. They then claimed when she contacted them that they have not recieved them ! She has a signature and delivery details evidence etc which she has shown them but they are basically saying not here, do not contact us again etc.
Cannot raise dispute through Ebay as its over time, anybody got any suggestions on how to resolve, I know its only £50 or so but its the whole principle of the thing thats damned annoying.

If they're still an active ebay seller, you could try contacting ebay. It's a long shot, since ebay are rarely helpful at the best of times, but it might get you somewhere.
If not, write a letter stating your case and evidence (i.e. you have a Royal Mail recorded delivery, yet they're saying they haven't received any delivery from you) and that if you do not receive a refund or replacement within 28 days you will take them to the small claims court.
It might not actually be worth going to the small claims court over such a small amount, but the threat of it with the evidence you have would probably be enough to scare them off the idea of ripping you off. Especially considering it would cost them more to defend themselves than it would to replace the trainers.0 -

Your seller has a legal responsibility to sort it out - they are responsible for faults arising within the first six months, and this is just typical of some eBay sellers, unfortunately - they don't realise what they're getting into or what their buyer's consumer rights are.My partner bought a pair of Reebok trainers through a seller/shop on Ebay.
