Cond out of £5000 by PPI Settlement Company

Good Morning. This is my first post on the forum but i have read through other post on here for a few years. Basiclly im at my wits end with a company who cond my Dad out of £5000. Here is a back ground on him and what has happened. hopefully someone can help.

My Dad is 73 and two years ago had a fall which caused him a brain injury and left him in a coma in intensive care. he made a recovery and then spent a further 4 months in rehab before returning home and work. He has not been the same since and has become quite vaulnerable. I have to ensure all these companies that phone up offering things speak with me as he would probably accept them not knowing enough about what he is signing up to.

At the begining of this year (March time i believe) and unkown to me my Dad was contacted by a PPI settlement company (will post up name of company when i get it) who said they could get him £17000 in miss sold PPI. They then asked him to pay £5000 (which he used a credit card to pay) for them to take this on. Now my older sister who isnt about all that much contacted them but it doesnt seem to of done much. My Dad is aware now that he was cond and that he is a vaulnerable adult and has since been trying to contact this company who have said that this would be sorted and he would have his money by the end of June/July. Obviously its now coming up to October and still no money. He contacted them last week whiles i was at work and they said they are sending him something in the post. Actully all he wants is that £5000 back as they never should of taken it in the first place. Im just worried the comapny is magicly going to disapear off the face fo the earth.
I guess im wondering if we have any sort of case against this. My dad is a vaulnerable adult with an Acute Brain Injury, and this company have taken advantage of a vaulnerable adult and had him agree to something over the phone without (from what i know) signing anything and certainly not seeing if he is competent to consent.
In my field of work if a client is not competent to recieve threatment we need family permission to go forward. i would of hoped there was safeguards in place for vaulnerable adults as well.

Any help or suggestions would be great. Thanks (and sorry for all the spelling mistakes).

    Whilst financial services companies would actually provide a high level of consumer protection for him in his condition, claims companies are regulated by a different regulator who has set very low and basic requirements. This is why there are so many dodgy claims companies and even the big ones break the rules (see recent watchdog episode).

    Once you have the details, make a formal complaint to the company and to the Ministry of Justice. Taking £5000 up front is a disgraceful amount. Also, consider going to the media. Claims companies like this need to be put out of business and a number of media outlets are currently building up stories to run.

    Was it a CREDIT card or a DEBIT card? (This is important).

    then report the payment to this scam company to his credit card company, they are most likely be be able to get the money back.

  • That is discraceful definately one for watchdog and hopefully they are regulated by the ministry of justice so that they can give you some advice on the way forward, Good luck
  • It seems likely that he will be able to claim the fee back from the Credit Card provider. He will need to write to make a claim under Section 75 of the Consumer Credit Act.

  • thank you for your advice. i will certainly be following this up with him and the credit card company. as for the name of the company he cant remember. i know they have a website etc because i checked it out so if it comes back to us ill post it up. thanks again
