A straight answer to your question then.

If item is untracked then technically it is possible to do an INR as long as seller cannot show delivery then you will win.

I think though that most people would be looking at this from a moral point of view- and only you know where you stand on that.

Thank you for that, I didn't see the bit I had to click on at first.

I don't expect the seller to be out of pocket. I asked the question before really thinking about it. My initial thought was I may not receive this item so I just wondered if I could have claimed for it. I had the answer in post 2 thank you.

I called the number hermum gave me and they are going to change the address as it hasn't left the warehouse yet.

Fantastic customer service as it does say they can't change order details in their T&C's. :T

Have made sure new address is the primary delivery address now
