OSPS trying to avoid paying cashback!

Sent them my 12th bill, but they claim it was sent before I was eligible!

signed up on 20/1/06 therefore I sent them my month 12 bill dated 20/12/06 (which covers 20/12/06-19/1/07), how on earth can that be sent before I'm eligible if it's the final bill?!

Is it better to go through trading standards or small claims court? (is the £30 fee refundable if you win?)

  • it cost me £50 to claim against mobile rainbow, depends on amount of claim, and the cost of claiming is added into your claim against them so you get your £50 back aswell.

    You only get the costs back if you win. You will lose so don't use the courts.

    osps contracts are specific, so as you broke the terms you won't win a court action against them. (You have to claim when you have been connected for 12 months - nothing to do with the date of the 12th bill)

    Trading standards will say the same - you should have stuck to the contract terms.

    Try sending another claim in when it's due. After 20/1/07.

    I don't think that they are trying to avoid paying your cashback. You have misunderstood what is meant by the 12th bill. If you signed up on the 20/01/06, how can you have received the bill for the 12th month now (15-01-07)?

    They have pointed out your mistake, so do as you have been instructed. If you don't, you will not get your cashback!

    The billing go OSPS is based on the date of connection.

    So if you were connected on 12 Jan 06 say at month 12 it would be 12 Jan 2007.

    Your billing date is indepedent of the connection date. You have to send the most recent bill. OSPS is right you have sent the paperwork too early. Wait until the right time so for month 12 =365 days after your connection.

    I always send copies of bills, and sent it recorded del.

    If they lose them, and you have a recorded delivery they will accept faxes.

    You have time to send in another claim same as the previous one but sent it on the 19th Jan so they get by the 20th Jan!!

    This must be specific to OSPS (or rather, each retailer has their own interpretation, so you definitely need to check how they intend it). I am on an o2 contract with Mobileshop and the 12th bill is as the original poster indicated above (ie contract taken out 25 January 06, 12th bill 25th December 06) - with o2 it is slightly easier as the number is printed in the corner of your bill. However, as I understand it, it is the 12th bill as you are paying for line rental in advance (and December was the 12th time I had needed to stump up!).

    Out of interest, with OSPS do you have to still be connected when you make your final claim? If this is the case, you would be paying for 13 months (at least)?

    OSPS as far as I understand not go by the date of the bill but how long you have had the contract for. Therefore you send the cashback voucher after say the 4th month, 8th, 12th. You do this anytime after the date ie, if it was taken on the 25th anytime after the 25th four months later. The bill you use is the one you have had previous to that date.
  • the bill I sent was my final bill, I won't be getting another bill as i cancelled after 12 months i.e. 19/1/07 therefore that last bill covered the period for month 12.(20-12-06-19/1/07)

    No, you will still get a final bill after the contract has ended.

    But the bill is irrelevant.

    You broke the terms by claiming the cashback too early (as they have told you).

    Read through your paperwork (and the replies here we have made to try and help you).

    Don't waste any money taking them to court over this - you will lose the case.

    If you signed up on the 20/1/06 you have not been supplied with 12 months service until 20/1/07 i.e. 5 days time!

    If you do not do exactly as required, you are not eligible and will lose your cashback.
