Using SIM in Different Phone Allowed?

I noticed someone drawing attention to this T&C on The Mobile Outlet (on the Onecompare discussion board) and wondered if any other retailers did this.

According to The Mobile Outlet T&C (http://www.themobileoutlet.co.uk/Information.asp?txtMode=8), you have to use the SIM and Phone that they have provided together:
17.3 When you buy a contract/pay monthly package from us you must use the provided sim card with the provided phone. If we receive a 'non usage report' from the network that you are connected to, you will be charged the full retail price of the handset via your credit/debit card details.

As I am looking for my next deal on contract, but will be using the SIM in my existing phone as I like it (and probably selling on the phone, as I don't really need it), I thought I better check - do other retailers have this condition? Does this actually refer to the SIM being used or would/could they get a "non usage report" that actually shows whether the phone and SIM are being used together? I have had a number of phones on cashback over the past few years without a problem (and have yet to use the SIM in the phone it came with) but as I have not used The Mobile Outlet, I didn't know if this was a usual T&C or something new to watch out for?

    They won't receive a 'non usage report' if you use the SIM from the network that you are connected to.

    make your first calls on the new phone then its registered by the network as supplied & used, this is to stop dealers box breaking ( selling seperate bundled sim/mobile phones ), should you fail to make any calls on the new handset your mobile company may not send the comission to the retailer/dealer and if you got cashback deal then that could cause you problems
