Please advise me on selling my upgrade

Hi there,

about to get a new upgrade (Motorola 635 from Orange) and have seen these beauties changing hands for £200+ on e-bay.

Thought I'd heed Martin's advice and save the money rather than keep a phone I dont need.

I have heard elsewhere that I may be liable for a charge if Orange find out that I do this...is this true?

When I was speaking to Orange they said that the new phone will come with a SIM and that I should phone Orange to register the phone.

Excuse me for being dumb, but bearing in mind I am selling this would the correct form of action to simply be to remove the new sim and not phone Orange.

They said that the new SIM is required for some of the functionality of the phone (video messaging). What I dont want to do is risk having someone register the phone in my account and I get charged for the calls.

Any advice would be appreciated.

When you get the upgrade you have to ring Orange to register it. It is likely they have blocked the phone incase it got lost on the way to you. So when the package arrives, remove the SIM from the box and put it in your old mobile. They should unblock it for you give you a SIM update, and then you are free to do what you want with it.

As long as you keep the SIM, whoever you sell the phone to can not access your account. When you sell it, you should state it doesn't come with a SIM card and is locked to the Orange network.

I don't think Orange can say anything about you selling the phone, as technically you are paying for the cost of the phone through your line rental.

    Hope that helps.
  • Thanks for the advice.

    One further query.

When you say it is likely they have blocked the phone...how can they unblock the phone if my new sim is in my old phone?

Did you actually mean that the SIM will be blocked?

Sorry, just don't understand how the phone can be unblocked if it is not on and has no SIM in it.

The phone won't be blocked, just the SIM until you ring Orange and activate it. The phone may be "locked" to only use Orange SIMs. But if you take it to a shop they'll unlock it to take any network SIM (except "3").

if i were you i would check with orange before you sell the phone

vodafone told me that i was breaking the law by swapping my phone before the end of my contract
i lost the phone i was using and requested a new sim card, they queried why the IMEI number didnt match the type of handset i was meant to have n i said i had swapped it, simple as!

they said the handset was sort of "hire-purchase" and only when the contract ended would the phone belong to me
until then, they could claim the handset back at any time
i was near enough accused of fraud !!
all i wanted was a new sim card

i think its best to check with orange to be on the safe side, or at least make sure you fully read the small print

would be grateful to find out if what vodafone said was true tho... as i was v distressed at the time

Sunflower - would that apply if you bought a PAYG and were looking to sell it straight away?

I was of the opinion that the phone was "FREE" but in the small print it states that the sim card remains the property of the Network....so I cannot see why you cannot sell you free phone as long as you retain and pay for the sim for the duration of your contract

Everything I have read on this says the phone is yours to keep from the start. Unless Vodafone have T&Cs that vary from the norm. but I don't think they do.
