Gamestation return & refund policy

quick story....
im a pc gamer, thought id try xbox, order used one online, arrived wednesday,setup all ok, but didnt play as no games. Bought 2 today again from GS local store. 30 secs into the game, black screen,white vertical line then red ring of death. Turned off, tried again 5 mins later same thing,tried HD cable same thing.
their online returns state
"Hardware (gaming consoles) or peripherals (gaming accessories) may be opened for the purpose of inspection (but not used) and returned for refund or exchange within 28 days of the despatch date. Hardware must contain every component part (cables, memory sticks etc.) before it can be accepted as a return.
Faulty hardware may be returned for a like-for-like exchange up to 12 months after the despatch date."
I do not want an exchange I want to buy new and GS is not the cheapest option I just want a refund If they refuse could I do a charge back on my debit card??

If there not willing to repair, exchange or refund. Then i would do a chargeback.... But some will say thats fraud.0 -
no you cant do a chargeback - refund, replace, repair at the choice of the retailer.
You *might* get goodwill for the new Xbox if you bought it from Gamestation - but it would be down to the individual store.0 -

thanks for the answers, just tried Asda`s for a new one, picked up the box take to till.......sorry we have no consoles in stock

This is incorrect.
The refund, repair or replace option only applies for goods that fail after they have been accepted by the buyer.
The console in question here was faulty when received and the OP is therefore entitled to a full refund.0 -
You could also return it under the DSR for a full refund.0

took it back to the local store,showed them the ropey AV cable that came with it, they plugged etc, picture fine,i said give it a minute, so he proceeded to play a game, then right on cue......no picture and rrod
upgraded to new model with GOW3. at extra cost but i didnt want to take another chance with a used model. Guys were really helpfull tho.
