Mobile Phone Refund.
I bought a Mobile Phone from my local store of Argos, the lady serving me opened the box to check to see if it was the right colour. I took the phome home and my Son siad he didn't like it. The next day i took it back but they wouldn't give me a refund even though they had opened it. When I got home I rang customer services head office, and explained the situation to them. The Guy i spoke to said they have to accept the phone back and I should have a full refund as it was them who opened it in the first place. He said he would ring the manager at the store, he did but the Mananger said he will not accept the phone back or issue a refund.
What I wan't to know can the Guy from customer Services overide the decision of the manager at the store i got the phone from? What should be the next plan of action.

Argos don't offer there 30 dya money back policy on phones and as it was bought in store theres no DSR to use.
You've no legal right to a refund unless it's faulty, not liking the coulr in not a valid reason.
You can try again but as the catalog excludes phones rerdless of if it's opened or not your relying on the stores goodwill.

There's no DSR, but there is SOGA (Sale of Goods Act). Unfortunately, did does not cover change of mind as any exchange is only at their discretion. If genuinely unused, sell it on eBay AS new and boxed, then buy a replacement AFTER consulting with the boy (or purchase online and be covered with the Distance Selling Regulations which allow for this).0

Unfortunately customer services cannot override the store manager. It's very easy for a CS agent to tell the customer what they want to hear, they don't have to deal with the wrath of the customer instore. I used to work at Argos for years and this was a constant problem!
As for opening the box instore, they do that to make sure everything that should be there is there and to stop people coming back and saying there's no phone in the box.
I really doubt you'll find any Argos store that will allow you to return the phone.
Your best bet is to sell the phone on ebay as Buzby said and keep the O2 top up voucher for your next purchase.
