Broken bed, what are my rights?

Less than 6 months ago I bought a double divan bed and mattress from a major supermarket, not long after getting it I sat on the end of the bed and the top cracked leaving a big sag. We're both healthy weight and the bed is only used for sleeping and the other normal activity! No children bouncing up and down on it.

I contacted them and they agreed this was not correct and someone would get it touch with me, they never did, I called again and found out that they no longer made the bed and someone would be in touch to resolve, yet again they never did. I think part of the problem is the bed we got was a very good deal, I think there was a miss-price on their website as the price increased by over £100 in the days following us placing the order, we also ended up getting the delivery price refunded as it took much longer than the guaranteed delivery to arrive. The nearest comparable bed now is over double what we paid and their supplier is reluctant to replace.

I'm going to call them again tomorrow as I want this sorted and wanted to find out what my legal rights are. Any advice is much appreciated.

Many thanks,

Best to keep quiet about sitting on the bed to be honest. It sounds like a wooden rail has snapped. If its a draw base by removing a draw you might be able to see the damage, might be a knot in the wood
(Edit just to add that tesco regard repeated sitting on the edge of a mattress as misuse,I used to inspect beds/furniture for a living,So please just stick to just the basic my bed is sagging when dealing with the retailer/makers)

You have the right to have a bed that doesn't break irrespective of you sitting on it or even if you did get it slightly cheaper, unless of course they pointed out that the bed had a tendency to break and you still agreed to purchase.

I think as you have asked nicely over the phone you should now get something in writing either phone them again then write to them with your understanding of the agreement or write to them asking that they replace repair or refund. That way if they continue to prevaricate you have something in writing if you need to take court action.

Your contract is with the company that supplied you the bed their problems with their supplier are their problem and not yours.

There is a sticky here that gives a decent basic understanding of your rights
