I've just had words with my neighbour for blocking me in because he could not get onto his parking bay as someone had taken his allocated space already.
I got annoyed because he took it out on me by blocking me in rather than parking behind the offending car in his space. When I raised the issue with him he apologised but said he had done nothing wrong in his eyes - you are parked behind me blocking me in with a dropped kerb in place!

This is not the first time we have had words. Two guys live at this address and both have cars, though the other guy is very understanding.

What I want to know is it a criminal offence to block someone in while parked on a side street where there is a dropped kerb? If I reversed into the offending car coming off my parking space would I be liable for the damage?

Thankyou

It's an allocated parking bay at the side of my house off the road with a dropped kerb. The road infront of my house is a public highway.

It's very annoying when it does happen believe me. Why some people feel the need to be so selfish these days is beyond me.:(
  • I`m not certain as alot of what I see on the net is hear say but I remember reading that it IS an offence to block somebody`s car whilst it is on their drive as if there is an emergency they can`t use the car i.e to take somebody to hospital. I also believe that it IS'NT an offence to block a dropped kerb if there is no car parked on the driveway as you would still have use of your car, just not be able to park it on the drive. Like I said this is all hear say. The local Police or Council would be able to give you their stance on it...

My kerb has been blocked once since I bought the house in May. I did`nt need to use my car at the time and they were gone in about ten minutes. I made a note of the make, model and reg and I now know who they were visiting so if it happens again I know where to go. The most stupid thing about it was that there were spaces on my street but they parked over my dropped kerb
  • sorry to hijack does anyone know what the law if any of parking across a dropped kerb for pedestrians-the cojncil have put one in our close which is ridiculous as its only used byt the residents and we're a very small close

its not affecting the main road joining it as its on a separate section further down-just wondered if u could get fined for it-not that we ahve many wardens round this way

He can be given a ticket for obstruction if you call the police. He is blocking your access to the highway. If you were not at home and he did it, he could not be given a ticket, unless there was a local bylaw enforced by the council wardens, as this would apply whether or not you were at home.

They are usually covered by special enforcement areas, which means you can get a ticket if you park next to them.

You can definitely be given a ticket. My wife got one for parking 1ft over the end of a dropped kerb at work even though the person who owned the house could get in and out fine, didn't complain and actually pops round for a cup of coffee so knew where to go if there was a problem.
