vodafone upgrade

hey just a quick question, my OH was eligible for a upgrade as of yesterday, she wanted the iphone4, i told her to wait for iphone 5 so price would drop on the ip4 but she wouldnt, anyway she agreed a deal over the phone with vodafone, this deal is way overpriced and the phone is getting delivered tuesday, she has 7 days to return the phone if not happy, does this include the contract aswell?
the deal is 900mins unlim txts 750mb for £41 a month.
her current deal is £25 a month for 600 mins unlim txts.
vodafone told her she would have to pay £99 for the phone on a £35 a month tarriff, the phone was only available free on the £41 deal hence why she accepted.
i told her to shop around but she got giddy, but ive since found a contract similar to what shes on 600 mins unlim txts and 500mb for £34.75 a month with free handset(ip4 white) from........yep youve guessed it vodafone.
so what i suggested is to return the handset n simcard leave it a week and then ill ring on her behalf n haggle the deal she wants, will this be possible?

How long is the new contract? It wasn't 24 months, was it?
If it was 24, then I see £39 deal at Voda with 750 minutes and £40 cashback for the new customers. Aslo I see 2000(!) minutes for £35 at Three.
It will take a while to save for a house deposit with such wife...0 -

Technically Upgrades are not covered by the DSR but you should be able to return it no problems.
Also the Iphone 4 as it is wont drop in price.
Apple historically withdraw stock and bring out a cheaper version when a new iPhone is released. Rumours are (and these won't be confirmed till Apple release the IP5) that the 16 and 32GB iPhone 4 will be withdrawn and a Iphone 4 8GB will take it's place. Yes it may be cheaper but it will be a lower spec.
You didn't say how long the contract was but £35 x 18 +£99 = £729
£41 x 18 = £738 so it's cheaper overall to pay the £99 It's also works out a bit cheaper on the 24 month contract to buy the £35 PCM contract.
It also depends on her use, if she goes over the 600 minutes or 500MB of data that £6 difference will easily be eaten up in out of bundle charges.
The new offer may only be for new customers not upgrades, and in any case there is very little chance that you'll get much of a deal on iPhone, they don't need to discount them to sell. You'll also need to be on the account as a registered person for Vodafone to deal with you and look at it from Vodafone point of view, they'll have it on file she accepted the higher deal, so your negotiating from a position of weakness.
You can get around the new customer but by porting the number out and back in but it's hassle.

With any deal that you take out with us, you have the first seven days to change your mind and return the handset.
If you are unhappy with the deal too, you can change onto a different one within this period. You will need to call Customer Services on 191 and speak to our returns team and they can discuss this with you.

I've contacted vodafone and arranged to refuse delivery, well then upgrade through a 3rd party for the better deal0

Two things to bear in mind:
1) Online VF now appear to allow upgrades 6 months before contract end so beware how the the new contract is.
2) If you have a £40 and above contract VF 'give you' 25mb per day EU data roaming which is useful if you travel a lot.IT Consultant in the utilities industry specialising in the retail electricity market.
