Can't pay for an item

Might be a daft question, but I can't pay for an item at all. Paid via Paypal, payment was unclaimed and seller unregistered. Tried contacting seller a week ago, but to no avail.
Am I right in saying that I would only get an unpaid item strike if the seller initiates a claim?

No, if seller is stupid enough to try an unpaid claim just submit the original transaction number of your unclaimed payment.
It is not your fault that seller is ignoring you and cannot communicate sufficiently to get their payment.
Incidentally does seller have any current aucitons running? If so you could try using 'ask seller a question' via the link as that might get their attention. I have exactly the same problem, I won an item, listing clearly stated Paypal, tried to pay, bounced back, seller told me no Paypal account could I pay bank transfer, which I won't do I will only ever pay through Paypal! I have asked that they cancel the transaction, but to no avail, they just keep telling me to ring them to sort it out, in my eyes theres nothing to sort, I will only pay via paypal its quite a lot of money and I am not taking any chances. At the end of the day if the listed item had said no paypal payment, I wouldn't have bid on it! I am stressed to the hilt about it, as I need this item quickly, I am scared to buy another one in case I have no choice but to go through with the sale for the origional one!

Personally I would walk away from this. If seller opens an NPB then you can appeal it by showing your attempt to pay bounced. Just keep an eye on your ebay aco!!!! though as some sellers are a bit dim and he might try recovering his fees- if you get any further correspondence from them ask on here again.

Thanks Soolin :beer: will keep a close eye on things, what a pain its been though! I am worrying in case Ebay say for me to send a cheque, I don't want to do that as it just take too long & I needed the item by Thursday.grocery challenge Sept 2012 £21/£3990

Buy another one.
I think even if you go through with this one, your chances of actually seeing the item after you have paid are very low.0 -

I would hope that even the customer services reps on ebay are not that daft (although I wouldn't bet on it!) . Personally and although I know it can be a worry I really would walk away from this now.
Worst case scenario is that seller opens an NPB and you have to spend time appealing it- that is the worst that can happen here. You have tried to pay so that's the end of it, you cannot be expected to hang on for ever. Sellers whilst not necessarily outright scammers for refusing paypal, tend to need to keep a low profile. Yes they might get away with it for a short while as there will always be buyers who play along. However, the last thing these sellers need is to come to the attention of ebay- so they ar eunlikely to want to try to much . If you wanted (and I certainly would) I would check the reporting mechanism as there are reports allowed for where a seller has refused paypal- report them for that and any other policy breach, as if you can get your listing pulled or the seller restricted they can't even try a speculative NPB.

OK, seller has just come back to me saying they have set up a Paypal account now so I can pay them the money. I think this will be ok, what do you think? I'm nervous now about the whole thing:(grocery challenge Sept 2012 £21/£3990

You can request an invoice and go back through ebay checkout again if the original unclaimed payment is cancelled.
Don't send a 'gift' payment' - it invalidates your buyer protection:
From eBay buyer protection policy:You sent payment to the seller using the "Pay Now" button—including situations when your transaction was completed through a third party checkout—or through the “Send Money” button of your PayPal account by selecting “eBay Item” and entering your eBay User ID and the eBay item number.
