E-Bay Problem..

Hi.
I brought a ps3 from a seller off e-bay who told me it had a faulty blu ray. I received the ps3 and it would not even power up and gave the YLOD fault. This is a totally different fault to the one described to me by the seller.
I opened up a case in the resolution centre for an item not as described. E-Bay found in my favour and refunded my money in full.
The person who missold the console to me said that they want the console back. Fair enough i have no quams about that. What i have told them to do is to forward the postage cost to me so i can return it. The seller is refusing saying that i should pay to send it back out because e-bay refunded my money in full thus because they sent it they paid for the postage. I sent a return mail saying that if they hadn't had told a lie about it's condition then this would never have happened and quite rightly they should be out of pocket because of this.
My question is as this is not my fault in anyway and i have only received the money back i origionaly paid am i liable to pay the return postage..? If it is the case i have to i will be out of pocket by £15 because someone tried to con me on e-bay.

As a seller I won't refund until I get it and I won't refund postage until its sent. I will book a collection at my expense but I will not send someone money to pay for the return. What is there to say they take the money and run? You have no leg to stand on.0

No stick to your guns and if they dont send you the postage costs then ignore them and either throw
it away or give it to a charity shop. But do offer them enough time to sort delivery out.
One thing to watch is they dont send money via paypal then claim it back. Maybe a gift payment or get them
to arrange collection of the item.
I presume you have left appropriate feedback to let others know they has misleading descriptions and are a PITA to deal with.
Polite truthful and dont mention ebay/paypal disputes.Censorship Reigns Supreme in Troll City...0 -

I think you are wrong, i have just found this. Here's some information about: Return postage costs
In general, the seller is obliged to pay for return postage costs, unless they specified in their return policy that the buyer pays for this. Sellers can also provide a return postage address and additional return postage information for the buyer in My eBay.
If they sent the money through paypal there would be a way to reclaim it should "whomever" just take the money.

Thanks for that, so paypal wouldn't be a good route then..? Even if i sent it recorded and then have proof it was delivered..?.
I think i will tell them to arrange for a courier then... If they can even be bothered. I just think the seller was peeved because they never got away with it.0 -

And I posted this yesterday, your quote comes from business sellers DSR obligationsBuyers are required to pay return postage, except for rare situations when a buyer and seller agree to another arrangement.
I think it all comes down to who as actually refunded you,if it's Ebay call them and ask what they would like you to do with the console.
If it's the seller then you do have their goods without having paid and if they want them they should pay for return.0 -
Do you know if the refund was taken from the sellers account or if it was a "no fault" ebay refund?
If it was an ebay refund then the seller has no right to the console as they still have the original payment that you made.
If the refund was taken from the seller then the only way that this would have happened before they received the item back would be if they didn't reply to the dispute process.
When this happens, the dispute automatically goes in the buyers favour and a refund issued from the sellers account.
If this is the case then you should stick to your original plan and make them send you the payment to enable you to return their misdescribed goods back to them. Make sure they pay enough to enable you to do this by a trackable method that offers enough protection for the value concerned).I think i will tell them to arrange for a courier then0 -

So your opinion is that the seller should pay the return postage then.
Many thanks.0 -
It sounds as though ebay may have done a no fault refund so the seller hasn't had money taken from. See exactly what it says on the response from ebay detailing the refund.0
