Cant Cancel phone for Three Network

I bought a iphone 4g contract phone from three network, dont want it now, because cant receive reception on it, phoned three network to cancel, they said i cant, because they say i have used the phone, bought the phone yestersday, Is that true that i cant cancel it?

Bought the phone from the three shop.

    If you bought it over the telephone or online then you have 7 days under distance selling regulation.

    If you bought it in-store it's at the managers discretion. Almost always the answer is no.

    If you can show that the majority of the time you aren't able to get enough reception to make a call, then you may be able to return it on those grounds - but, no guarantees.

    7 days under DSR are only for unused items and services. Both were used here.

    I think it would be reasonable to check the rules and the returns policy before buying, not after buying and using.
    Returning mobiles purchased online or by phone – ‘distance sales’

    If you’re a Three customer who purchased your mobile via three.co.uk or from Three's own telephone sales team and for some reason you change your mind and wish to return your mobile, provided you have not used your mobile, you can return your mobile and original boxed accessories to us in “as new” or “as sold” condition in its original box, along with your proof of purchase (your delivery note), within 14 days of delivery.
    This policy doesn’t apply: 1. to customers who did not purchase their mobile via Three’s own telesales team or via three.co.uk, or 2. to customers who have used their mobile (this means that you may not personalise your mobile in any way, or use any of the Three Services, or take photos or videos or load any data onto the mobile).

    Cancelling your mobile contract early

    Before you sign up with a new mobile service provider, check whether you have the right to cancel your contract and, if so, at what stage.
    If you cancel before the minimum contract term is up, you'll have to pay an early termination fee. In most cases this will be very high - as much as the cost of all the monthly fees until the end of the contract term as a lump sum. So, if you signed up to an 18-month contract and want to cancel in the second month, you might have to pay 16 months' worth of fees.
    At the moment there are no rules in place that allow you to cancel because of poor network coverage - this includes if you move house to an area where you can't get a mobile signal.
    If you want to cancel after your initial contract term is up, you can do so at any stage, although most companies require 30 days' notice. Source Which

  • First of all, do you want the phone, but you only want to send it back due to the signal issue?

    Assuming you want to keep the phone, can you get a signal anywhere?

    and, although this may be a little bit to late, if your thinking of changing networks, then get a cheap pay as you go sim card for your chosen network to check reception before you commit, PAYG sims cost as little as 99p.
  • Interested to know if before buying you checked Three's coverage using their site map/reception locator. If you did, is your house in the zone where there is coverage or was it outside of the area?

    But M&S let me change my jacket if it doesn't fit and I can take back stuff to BHS and other High Street stores, so why can't I return a mobile phone I have used, or change my mind a week after I get married 'cos she snores or change my car a day after I drove it off the forecourt?

    Why should I check out the conditions before I buy anything or even check that what I am buying fits my needs? As I said, if M&S can do it , why doesn't that apply to everything? ;)
