These companies are trying to have their cake and eat it. Its either a byelaw 14 punishable at a magistrates court, or set aside on the payment of a penalty! Or its a civil matter which they can pursue at county court. How can they have it both ways?

I have spoken to a BTP sergeant who told me the only byelaw 14 he has ever known was issued for obstruction!
  • Nicely written by Coupon-mad.

I cannot see why a TOC with its power to enforce byelaws is using debt collectors for a demand unproven in court. It is odd. I mean, all right, say it is Byelaw 14. What will happen when the respondent says in her defence that she had been harassed, that if the demand were genuine a case could have been pushed much ealier? Either she contravened a byelaw or she didn't, where do all these debt collectors and their increased sums come into the legal factor?
  • Thanks all. To be fair I think my preferred course of action would be to not write to them. This is purely because of what I read in the other posts about not writing to these bandits as they then smell blood and will try to hassle you. Is this a bad decision?

Re the byelaw thing they haven't mentioned yet which byelaw I have contravened. They could argue that it was 14 and that I was causing an obstruction for not parking within white lines. However they have no proof as there was no photo on the ticket etc so surely would they not have to prove I was causing an actual obstruction?

Not sure what you mean Renegade, the letters have been sent to me from their (the TOC's) own legal dept so it's not a separate debt collection co. Does that clarify?

Hello mucky. It was Pudsey station not Leeds central. Apparently the bandits are not always on patrol. I was unlucky that day.

Just wondering - did anything come of this?

I too got a parking notice from Pudsey station, both letters which I ignored, and now have received a summons to court with a date in a couple of weeks.. needless to say I'm quite worried about it. The letter mentions byelaw no.14 too..

Northern Rail are the only train company that actually pursue motorists through the magistrates court. So this is not a "fake " PPC ticket but a real one. I am afraid that the only thing you can do is to plead guilty and pay whatever they are demanding. I know this seems harsh but the experts over on PePiPoo have said the same about similar NR cases.
What part of "A whop bop-a-lu a whop bam boo" don't you understand?
