Downgraded Virgin, can I cancel without a fee, during cooling period?

Hi. I downgraded my 3 services with virginmedia, within the past 7 days. I was approached by a SKY salesperson. I informed them that I recently downgraded packages, that I didnt want to be charged an ETA. He told me that I would not have to pay a ETA due to the fact there is a 28 day cooling off period. Can anyone confirm this to be true, as I have sky coming friday to do the telly? thanks.

  • Why did you sign up with sky before you dealt with virgin ?!? phone Virgin and find out.

The SKY person kept reiterating I'd not have to pay. I can still cancel SKY though as I have checked the T&Cs on the contract.

he lied to you, as with mobile phones when you upgrade/downgrade, because it is not a new contract there is no cooling off period. However the change of package may well have triggered an extension of your current contract.

  • So, just to confirm I will get charged and will have started a new contract?

Yes, any change of tariff/package with VM starts you on a new 12m contract. No cooling off period applies, as it's an extension to the existing contract.
Why on earth did you believe someone who's only interest was the commission? They wouldn't even have worked for Sky-they're just freelance sales agents.

  • Phone Virgin.

    Read this: http://shop.virginmedia.com/the-legal-stuff/terms-and-conditions-for-cable-services.html#ending

And how it relates to this: http://shop.virginmedia.com/the-legal-stuff/terms-and-conditions-for-cable-services.html#changing

I don't believe reducing your package outside the initial minimum term will put you into a new minimum term, going by the terms and conditions only adding services starts a new term.

"You may add to or reduce the services you receive from time to time by contacting our customer services team. If you ask us or Virgin Media Entertainment to provide any extra services to you, you agree to accept those additional services for at least the minimum period that applies to them. If you ask us or Virgin Media Entertainment to reduce your tier of services within the minimum period for those services, we and/or Virgin Media Entertainment may ask you to pay a fee depending on the services being reduced and the remaining length of the minimum period."
  • Surely if it starts you off on a new contract, then the contract cooling off law applies.

I don't believe that adding or reducing services starts the contract afresh. It certainly doesn't with sky.

But if it does, then I'm sure that the relevant new contract laws apply.
One important thing to remember is that when you get to the end of this sentence, you'll realise it's just my sig.
  • All sorted now. just cancelled the sky order, spoke to Virginmedia retentions, that I'd been considering leaving got an upgrade on phone to L from M and TV was from L to XL and same M internet for £46. I was originally paying £46 before the upgrading. :j
