No it isn't, theft is an attempt to dishonestly obtain property belonging to another with the intention of permanently depriving the other of it, the OP has informed the seller that the item arrived and offered to return it at the seller's cost, at no point could they be accused of theft in any manner. The seller should pay the return as (I assume) they didn't post them within the terms on the listing.

Nonsense. I know ludovico has already explained very well why your comment is untrue but I wanted to add that as long as the OP offers to send them back at sellers cost he has done nothing wrong.

Seller sent them voluntarily. If I post something to someone even when they don't want them anymore, I don't think I can call them a thief.Realistically you need to either pay or send them back, if you don't the thief comment will be justified.
They should just have sent them when the OP originally paid - that could more properly be said to be theft, taking money without providing the item in return. Luckily eBay and Paypal have mechanisms in place to prevent theft, but that wasn't always the case.

That's not the same is it? The OP opened the dispute before getting the goods and then informed the seller once they arrived. You can make as many comparisons as you like but legally the OP's actions will not be classed as theft, nor morally do I think they should be.In the game of chess you can never let your adversary see your pieces0 -

Have you read the thread or can you not see the difference between a fraudulent claim for non receipt, and an unwanted item that turns up late and which buyer has offered for return?

The seller has now emailed saying if I give them my address then they themselves will pick up the DVDs (perfectly possible, only a 45 min drive away). I DO NOT want this person coming to my house therefore I offered to meet them in a public place.
Apparently this was not good enough and because I "won't compromise", their 'only' solution is to go to the police.
This was quickly followed by a request for my address so that a courier would pick them up but I'm scared this nutter will instead!
Any ideas?0 - 
            OMG! I'm getting as crackers as them! I've just realised they'll already have my address from having sent hte DVDs.
Im seriously worried now.0 - 
            Do you still have use for the DVDs? If so why don't you keep them and return the PayPal refund that you've received?0
