Tried to make an offer today but....

    Yeah but it makes me wonder how serious they are about selling... maybe they're just "testing the water" to see what sort of offers they get.

    Just goes to show that there's an argument for buyers being able to "vet" sellers too!
  • I have had a read of pages 1 & 5, at a guess that 2,3 & 4 are arguements.

    If i thought that the EA has not passed on the offer, I would write it on a piece of paper, and post it through the door of the property with telephone numbers/name etc.

    Either way, if the seller is interested they will get back in touch with you.

    I said I would leave the offer open until 17:00 today but haven't heard back yet; therefore I'm beginning to think they're not even serious about selling!

    Spoke to the EA last night. The vendor still hadn't accepted or declined my offer. They have more viewings booked in and had another offer yesterday. Basically they are trying to get people interested and then play them off against each other as far as I can tell. I told the EA to call me if and when they decide they are going to sell and I'll let them know if I'm still interested. I'm pretty annoyed as I've spent the best part of a week on this and could have been viewing other places. I knew this house could be trouble right from the start as it's priced as "offers over £x".

    By law, you must tell sellers as soon as is reasonably possible about all offers that you receive at any time until contracts have been exchanged (in Scotland, missives have been concluded) unless the offer is an amount or type
    which the seller has specifically instructed you, in writing, not to pass on.
    You must confirm each offer in writing to the seller, and to the buyer who made it, within 2 working days.
    The bolded section is the relevent one - we told our EA not to pass on offers from buyers who weren't able to proceed and also not to pass on silly offers.

    For us, as our property was not really a first time buyer property it meant that our buyer had to have sold subject to contract and if a first time buyer had made an offer I would have wanted some idea that they were able to proceed and not find out several weeks later thay couldn't get a mortgage. I would not have been interested in how much they could borrow - just that they were able to proceed. If they hadn't got MIP I wouldn't have wanted to have the offer passed on.

    We wanted to move and didn't want to have chains fall through because people couldn't get the mortgage they wanted or not be able to sell their house. It was up to the EA to screen the buyers - we were also screened by the EA who is handling the sale of our new property.

    It wasn't about getting the highest possible price funnily enough it was about getting a good proceedable offer, where things might actually have a very good chance of completing.

    We did have another couple very interested but they hadn't and still haven't sold their own property. The EA told us they wanted to make an offer too - but as they weren't proceedable it was a no go and if their offer had been higher than our buyers we would have still said no.

    Perhaps the vendor has instructed the EA only to pass on proceedable offers.

    Also our EA gave us no information about our buyer other than they were able to proceed.

    Walk away. I'm sorry. You should like a decent bloke who is just trying to buy a house, but the vendor is already playing games. It's obvious that the EA and the vendor are working together to try for a run of offers. What's to say that when you are even more invested, the vendor lets someone gazump you? No, I wouldnt have any confidence in this transaction any longer. It's up to you, but it's a buyers' market and the vendor is being very very silly.

    In fairness you did say the house had only been on for a week and they already have other viewings which suggests the house may be well priced and of interest to many? Nothing wrong with a vendor taking a couple of days to weigh up options - they are aware you may walk away.

    Just keep searching as this may not be the one for you

    The other offer may well be there, but that doesn't mean it's close to yours, or that they're proceedable. It's EA speak to make you up your offer. Same as using the 'more viewings booked in' line (and 'lots of interest', etc). Yep, there probably are viewers lined up... but I've had it all used to my face before by EAs on a couple of houses we'd offered on. They didn't accept our offers and there's no way we going to increase so walked away. Those two houses sat on the market for MONTHS and were reduced to way under what we'd offered, and probably took another hit with whatever they accepted.

    Don't be tempted to up your offer when it's not even been declined as such. They're pushing you into upping it again.

    No idea why you spent the best part of a week on this and didn't view other places. Why? I'd definitely still be viewing things until I had an offer accepted. Get ringing round for some other viewings! I'd take great pleasure in telling them I was no longer interested :p

    I agree. Probably if the agent knew you were not viewing other properties it would send the wrong message ... It's sort of the equivalent of 'lots of viewers and interest in this property'.
