Selling cashback phone?

Got an awfull clearance phone from e2save last month, spent many an hour on the landline to their "customer support" and am finally sick of them. Was going to get it exchanged for the second time but their systems were down, again, and the promised return call has never materialized. As the cost of the phone was "free" can I now just dispose of the thing to envirophone and buy a new one from a reputable dealer? It states in terms and conditions it's not mine until full payment has been received but what if it's free? Would clarify with e2save but can't face another eternity on the phone. Any input appreciated.
(As an aside, contract with t-mobile. I called them to see if I could use the sim card with another phone. Their helpline answered almost immediately, v nice lady listened to my tale of woe and was not surprised to learn the seller was e2save. Although not their problem she advised me to complain via their website and they may be able to escalate the situation to a point where something could be done.)

    Don't do anything until e2save tell you you can.

    My guess is that they'll want the phone back.

    your contract is for the sim card, the phone is yours to do with as you wish as it was a free gift..

    Usually in the retailer's contract it would refer to the fact that the stated cost of the phone (i.e. nothing) is dependant upon the SIM contract not being cancelled before the minimum term.

    If you cancel the SIM contract, I imagine that you would be expected to return (or pay for) the phone. I can't see any harm in keeping it for now and waiting to see if e2save remember to ask for it, though...

    Thanks for the info - still waiting for the callback from e2save about returning my phone 10 days later. The support girl assured me she would handle it personally - I believed her!!
    Got my landline bill from talktalk (cpw) and sure enough have made 9 calls to e2save and spent £13 on their "helpline", what a shower!
    Anyway off to sell my phone a buy new one from a reputable dealer.
