Mis sold house from estate agents.

I bought a house in Scotland a couple of years ago, it was up for sale as a three bedroom house. I have recently put it on the market but my new estate agent can only sell it as a two bedroom. This is because he told me that the third bedroom is too small.
Do I have any rights to make a claim against the original estate agent on the grounds that I was told the house was a three bedroom when it was actually a two bedroom. Had I of known, I would of put in a smaller price offer.
Would very much appreciate some advice.

    didnt you have a lawyer when you purchased it?

    Did you view it before you bought it? Did the third bedroom seem unusual in any way, compared to other properties?

  • The first thing you will have to do is to find out if there is a minimum legal size for what constitutes a bedroom and take it from there.
    I've never heard of this, but the law in Scotland may well differ to that in England.

    In my opinion I would have thought that a bedroom could be of any size as it could be for a small child and would only need a tiny bed in it.

    My in-laws' house is 3 bed, but the 3rd bedroom really is a box room - it just takes a single bed. (There is a cupboard built in to one wall). There have been no issues as I can recall about it being 3 bedroom. (To clarify, this is also in Scotland).
  • Yes I had a lawyer.
    The bedroom measures 2.8m x 1.87m
    The estate agent who is selling the house has told me that there is a minimum bedroom size and that these measurements are below the legal zise.

    Same here.

    We technically have a 4 bed house but when we came to view the house we could clearly see that the smallest room just about held a single bed.......we use it as a study.

    OP what do you use this room as ? If you use it as a bedroom then I can't see what the problem is ....just leave the bed in and let potential viewers mae their own minds up.

  • The problem is that the estate agent is selling it as a two bedroom so i'll get less money than what I originally paid for it. The bedroom is being used as a bedroom and has a bed in it.
    The real point is that I feel I was mis sold the house as a three bed.

    What makes you think the first agent was wrong and the second agent is right?
    Which law stipulates the minimum legal size of a bedroom?

    I'm scratching my head here . You viewed the house /offered on it and subsequently purchased it as a three bedroom .

    Regardless of the size of the 3rd room if it can take a bed then it then I would assume it is a bedroom ?


    In the UK, there's no legal standard or minimum size for a room to be classed as a bedroom - only an IIRC recommended (not stipulated) size of 8 sqm and a minimum width of 2.5m.as far as I'm aware .

    If your using the room as a bedroom then so could a potential buyer .

    In your position I would ask the agent to change the details .

    I would change your agent. I've seen smaller rooms than that listed as a bedroom!
