    I am just showing another side of the story and pointing out that perhaps there is more to this than a fraudulent account. So it potentially COULD matter.

    But you are suggesting that the OP's daughter may be a liar. You have read the OP's account and there is no other side of the story available, speculation is not required.

    OK, so on an internet forum, one purpose of which is to give opinons and points of view on different issues/questions raised, we must all therefore just take everything as read and not think of other causes or possible scenarios and not share our thoughts, and just go along with what every OP writes. They are only one person and many posts refer to other parties involvement in situations, but because those other parties are not present, and we are only hearing one side of the story, we should not give perhaps an alternative option to consider?

    I am not speculating, I am pointing out factual information, such as the fact that an item such as this requires a signature, and the daughter can obtain a copy of said signature should she wish to do so. *Sheesh*

    It's not common for accounts opened fraudulently to have payments made towards the debt. Also if ops mum has unknowingly signed for the parcel then from littlewoods perspective fraud looks unlikely, whether the case or not. So who signed for the parcel could well be of great importance, as if he signed for it it would go very well in ops daughters favour when reporting the account as fraudulent.

    We may well only know ops side of the story, but if op wants informed advise then it's always wise to ask questions not yet answered in order to get a clearer picture of what has happened.

    Hi Mandooz,

    If you feel that fraudulent activity has been used against your daughters name then the best advice we would give would be to get her to contact our fraud department directly to discuss.

    The telephone number you need to get her ring is 0844 822 4640. They are open Monday - Friday 8am - 6pm.

    Alternatively if you, or anyone else has any concerns regarding their own accounts you can email your account details along with your query to [EMAIL="help@littlewoods.co.uk"]help@littlewoods.co.uk[/EMAIL] and we'll be happy to look into any issues you may have.

    Just because there isn't a signature om paper doesn't mean it is unenforcable

    They can enforce a legitimate credit agreement the same way as any other debt... the courts, to obtain a CCJ, then licensed baliffs or attachment of earnings (amongst other pre and post court methods)

    if there is no sig then weres the contract. she has not agreed to the terms and conditions of the contract. its upto the company to chase the guy. without the sig anyone could takeout anything.

    A contract can be verbal, can be formed via email, via recorded/unrecorded telephone conversion, ect, ect.

    A tangible signature is not a requirement to forming a contract, it merely makes it easier in case of a dispute.

    A company should ensure their perform adequate security checks to ensure no fraudulent activity takes places as a person isn't liable if another person defraudes a company. If however you agree, whether via signing or clicking a checkbox online to the credit and it is legitimate (ie not fraudulent) you are liable for repaying the money.

    I hope to god you never give your advice to others, because it is both incorrect and ignorant to fact! Not only that, but I would hate to see somebodies credit report destroyed because they took advice from the wrong person.

  • thanks to all for advice.
    It would seem pointless to ask for advice and then tell lies about the scenario. I have no idea as to whether the phone was signed for or not as I did not see it. I have no reason to suspect that my daughter knew about it as she has been very upfront about everything and has no reason to lie.
    She and I have paid all his other debts without (very much) complaining as she did know about them or was responsible for them (e.g. council tax in both names and he was supposed to pay it as she paid gas/elec, she has now paid it as he actually didnt.) but this phone thing has been totally out with our knowledge and control.
    Anyway, as said, thanks for all the advice. I am not sure that the contract can be enforced but will speak to littlewoods and/or the police
